SUBJECT: APPROVING A SUPPLEMENT TO THE CONTRACT FOR CONSULTING SERVICES (#1)

WITH TPA PUBLIC AFFAIRS, INCORPORATED
DATE: SEPTEMBER 27, 2022
ISSUE
Shall the City Council adopt Resolution No. 22-57, approving a supplement to the contract for consulting services (#1) with Townsend Public Affairs, Inc.?

BACKGROUND
On January 11, 2022, the Mendota City Council approved a contract with Townsend Public Affairs, Inc. (“TPA”) for consultant services to apply for the Clean California Local Grant and the Recreation Trails Program for a total of $12,500.00 for services. The City of Mendota (“City”) did not move forward with the Recreation Trails Program. The project that the City anticipated applying for did exceed the amount of funding available with the Recreation Trails Program.

An application was submitted for the Clean California Local Grant from TPA. Unfortunately, the City was not awarded the Clean California Local Grant. The cost for the services provided for the Clean California Local Grant was $7,500.00.

The Department of Transportation (“DOT”) sent out an email to all applicants for the Clean California Local Grant for debriefing on the application. City Staff made an appointment to discuss our application and to find out how we could improve for future submittals. After the meeting with the DOT, the City learned that the application submitted for the Clean California Local Grant on behalf of the City was for a different city.

ANALYSIS
The City reached out to TPA to discuss the meeting with DOT. After the meeting with City Administration and TPA, TPA has proposed a supplement to the original contract entered in January 2022 to justify the incorrect application submitted. The services will read:

1. Notwithstanding previous work on behalf of the City, TPA will draft and submit three grants at the choice and direction of the City.

2. TPA will help the City develop, resubmit, and advocate for an application for funding in the next round of the Clean California Local Grant.

3. TPA will help the City with any applications for state legislative directed funding as well as federal community project funding.
2 Although the City was not awarded the Clean California Local Grant, we will have an opportunity to apply for the next round. The State has approved funding. However, the funds have not been appropriated. We anticipate hearing more on the next round of this funding in 2023. The project proposed for the Clean California Local Grant was the walking trails to the Pool Park, a newly constructed “pocket” park on 2nd Street and Bass Avenue, and Bass and Barboza Roundabout improvements.

The City will also have three opportunities for TPA to apply for grant funding. Projects that need grant funding are the backwash project, a community center, and an inclusive playground.

There is a grant opportunity that City staff is interested in applying for in October 2022. The Board of State and Community Corrections will be releasing Proposition 64 – Cohort 3. This opportunity will be a five-year program for a maximum of $3,000,000.00. City staff wishes to apply for this opportunity as one of the three grant choices as stated in the supplement.

FISCAL IMPACT
No fiscal impact. The supplement to the contract is $7,500.00. The City paid $7,500.00 to TPA for the original contract.

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 22-57, approving a supplement to the contract for consulting services (#1) with Townsend Public Affairs, Inc.

WHEREAS, the City moved forward with submitting an application for the Clean California Local Grant on February 1, 2022, but not submitting an application for the Recreation Trails Program due to funding caps; and

1 AGENDA ITEM – STAFF REPORT
TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: CRISTIAN GONZALEZ, CITY MANAGER; JOHN KINSEY, CITY ATTORNEY SUBJECT: RESOLUTION NO. 22-56: WEED ABATEMENT COST ASSESSMENTS DATE: SEPTEMBER 27, 2022
ISSUE
What are the facts and circumstances surrounding the City of Mendota’s (“City”) weed abatement activities in 2022 that support Resolution No. 22-56’s imposition of special assessments to recover the City’s enforcement costs?

BACKGROUND
Between April and July 2022, Code Enforcement engaged in weed abatement (public nuisance) enforcement actions against many properties throughout the City pursuant to Chapter 8.20 of the Mendota Municipal Code (“MMC”). Wide-scale weed abatement enforcement takes place at this time each year with the goal of causing property owners throughout the City to clear overgrown grasses and brush from their properties prior to the Fourth of July holiday to reduce the risk of fire.

Code Enforcement issued both a Notice of Violation and Notice and Order to Abate to the owner of each parcel listed in Resolution No. 22-56 (collectively, the “Owners”). These documents identified the public nuisances present on each parcel and ordered each Owner to correct them or be subject to forced abatement by the City with the City’s enforcement costs being assessed against their property.

After each Owner failed to abate the public nuisance conditions present on their property, the City applied for and was granted nuisance abatement warrants from the Fresno County Superior Court.

Each abatement warrant stated the City demonstrated good cause for abatement to the Fresno County Superior Court’s satisfaction and authorized City representatives to enter each property to perform said abatement work. As required by law, these nuisance abatement warrants were posted on each property for at least twenty-four hours prior to any abatement work by City contractors.

Following the completion of abatement work at each property, Code Enforcement collected and prepared a Cost Report identifying the City’s 2022 enforcement costs associated with each property. As outlined below, the MMC provides for the City’s recovery of all costs incurred in weed abatement enforcement actions as a special assessment against each property that fails to comply with a nuisance abatement order. (See MMC, §§ 8.20.130, 8.20.140, 8.20.150, 8.20.155.) At its September 13, 2022, regular meeting, the City Council held a public hearing regarding Resolution No. 22-56. After discussion with City staff and members of the public, the City Council continued the public hearing to its September 27, 2022, regular meeting to ensure the affected Owners’ complaints regarding notice of these enforcement actions were addressed in earnest.

2 ANALYSIS
I. MMC Requirements for Public Nuisance Abatement
MMC section 8.20.060 provides the City’s authorized representatives may effect abatement of a public nuisance by any of the following proceedings:

A. Issue a notice of violation; and/or
B. Issue a notice and order; and/or
C. Summarily abate; and/or
D. Issue an administrative citation; and/or
E. Request the city attorney to institute legal action; and/or F. Perform administrative abatement.
(MMC, § 8.20.060.) Here, each Owner was provided with a Notice of Violation (Subdivision (A)) and a Notice and Order to Abate (Subdivision (B)) prior to the City obtaining a warrant allowing administrative abatement on each property (Subdivisions (E) and (F)).

A Notice of Violation notifies property owners of the public nuisance conditions present on their property, identifies the MMC provisions that are being violated, provides the owner ten days to correct the violation, and warns the owner that failure to correct the violation may result in forced abatement by the City with all enforcement costs being paid by the property owner. (See MMC, § 8.20.070, subd. (A).) A Notice of Violation “may be served upon the record owner by regular first class mail or personal service. Service is effective on the date of mailing, or personal service.” (Id., subd. (B).)
Here, Code Enforcement issued each Owner a Notice of Violation outlining the nuisance conditions on their property and providing ten days to correct the violation. Each Notice of Violation was served via regular mail addressed to the Owner’s mailing address on record for each parcel.

A Notice and Order to Abate notifies property owners of the public nuisance conditions present on their property, identifies the MMC provisions that are being violated, provides the owner ten days to correct the violation, and warns the owner that failure to correct the violation may result in forced abatement by the City with all enforcement costs being paid by the property owner. (See MMC, § 8.20.080, subd. (A).) A Notice and Order to Abate “shall be served upon the following parties: (A) the record owner of the property; and, (B) any person, entity or corporation occupying or in apparent control of the property.” (Id., subd. (B)(1).) “Service shall be completed in the following manner: (A) personal service; or (B) posting the notice conspicuously on or in front of the property; or, (C) by regular mail.” (Id., subd. (B)(2), emphasis added.) Here, after the period to correct the nuisances identified in each Notice of Violation expired, Code Enforcement issued each Owner a Notice and Order to Abate outlining the continued presence of nuisance conditions on their property and providing ten more days to correct the violation. Each Notice and Order to Abate was served via certified mail to the Owner’s mailing address on record for each parcel and posted on the property. Code Enforcement documented these service efforts by executing Proofs of Service that attach the certified mail receipt and a photograph of the posted

3 Notice and Order to Abate at each property. (See MMC, § 8.20.080, subd. (B)(3).) These service efforts exceed those required by MMC section 8.20.080.

After each of the Owners failed to correct the nuisances within ten days of the Notices and Orders to Abate, the City prepared applications for abatement warrants which documented the process summarized above and requested the Court’s permission to abate the nuisances. The Court granted warrants for each Owner’s property and authorized City representatives to enter each property to perform said abatement work. As required by law, these nuisance abatement warrants were posted on each property for at least twenty-four hours prior to any abatement work by City contractors.

MMC sections 8.20.150 and 8.20.150 provide the City may recover all nuisance abatement enforcement costs it incurs correcting MMC violations where property owners fail to do so. If the Owners fail to pay these costs within thirty days of the City Council confirming the Cost Report, “the cost[s] shall constitute a lien upon the real property and shall be collected as a special assessment against the real property.” (MMC, § 8.20.150, subd. (B).) II. Mendota Police Department Investigation Regarding U.S. Postal Service At the September 13, 2022, public hearing regarding Resolution No. 22-56, several Owners indicated they had not received their Notices and Orders to Abate despite the City having certified mail receipts for the same and having received the Cost Reports that were delivered to the same addresses. Owners indicated some of the return receipts for these certified mail efforts contained signatures that did not belong to them.

As a result, the City’s Chief of Police contacted the local postmaster to investigate the Owners’ concerns. The postmaster indicated the U.S. Postal service, itself, has been signing certified mail receipts when delivering certified mail to reduce person-to-person contact during the COVID-19 pandemic. Upon delivering mail to a specified location, the U.S. Postal Service has been executing the certified mail return receipts and delivering the parcel.

III. Options Regarding Resolution No. 22-56
A. Option 1: Confirm the Cost Report, Exhibit A to Resolution No. 22-56 Although the Chief of Police’s investigation explains any discrepancies present on a certified mail return receipt here, no errors occurred in the City’s 2022 weed abatement enforcement efforts.

Pursuant to the MMC, a Notice and Order to Abate may be served by personal delivery, regular mail, or posting on the property. (MMC, § 8.20.080, subd. (B)(2).) Here, Code Enforcement exceeded all applicable notice requirements by posting Notices and Orders to Abate on each property and sending the same via certified mail to each Owner’s mailing address on record.

Notably, these Owners do admit receiving the Cost Reports which were delivered by the same certified mail practices.

Each Owner received all notice required by law (whether actual or constructive) and failed to comply before the City obtained warrants authorizing forced abatement. The City incurred $23,745.14 in enforcement costs effecting this work. Therefore, the City Council may approve

4 Resolution No. 22-56 and the Cost Report attached thereto as Exhibit A to recover those enforcement costs from the Owners.

B. Option 2: Waive All 2022 Weed Abatement Enforcement Costs If the City Council decides to waive the $23,745.14 in enforcement costs the City incurred, it may do so by voting not to adopt Resolution No. 22-56. These enforcement costs may be waived by the City as a valid use of its resources and exercise of its police power to maintain and protect the City and its residents. However, if the City Council elects to waive these 2022 weed abatement enforcement costs, such a waiver should apply to all Owners equally to ensure fairness.

FISCAL IMPACT
The Cost Report, Exhibit A to Resolution No. 22-56, demonstrates the City incurred $23,745.14 in weed abatement enforcement costs in 2022. If the City Council chooses Option 1, the City will recover the entirety of those costs from the Owners. If the City Council chooses Option 2, the City will not recover any of those costs from the Owners.

RECOMMENDATION
City staff recommends the City Council discuss Resolution No. 22-56 and choose either Option 1 or Option 2 as described in this staff report.
