1 AGENDA ITEM – STAFF REPORT
TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: CELESTE CABRERA-GARCIA, CITY CLERK
VIA: CRISTIAN GONZALEZ, CITY MANAGER
SUBJECT: CANCELLATION OF THE NOVEMBER 22ND AND DECEMBER 27TH CITY COUNCIL

MEETINGS
DATE: OCTOBER 25, 2022
ISSUE
Shall the City Council adopt Resolution No. 22-65, cancelling the November 22nd and December 27th regular City Council meetings and authorizing the City Manager to execute any necessary warrants?

BACKGROUND
The cancellation of the second meeting in November and December has been the City Council’s practice for many years in order to allow time for the Council and staff to spend time with family and friends during the holidays. In addition, during the years where the meetings have not been cancelled, there has been difficulty in obtaining a quorum of the City Council, ultimately leading to the cancellation of the meetings.

ANALYSIS
Staff is requesting that the City Council cancel the Tuesday, November 22, 2022 and the December 27, 2022 regularly scheduled City Council meetings due to the holidays. Aside from the City of Mendota, the cancelling of meetings during the holidays is a common practice followed by other municipalities. This practice is generally due to individuals travelling during these holidays which can result in difficulties in obtaining a quorum at meetings.

In the case that any pressing business was to arise that requires the City Council’s action, a special meeting could still be called. Also, the attached resolution will allow the City Manager to approve the necessary warrants for the meeting, which will then be brought to the Council for review and approval at the next regular meeting following the cancelled meeting.

FISCAL IMPACT
None.

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 22-65, cancelling the November 22nd and December 27th regular City Council meetings and authorizing the City Manager to execute any necessary warrants.

WHEREAS, year-end holidays provide much-needed respite as a time for all individuals to spend with family and friends.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Mendota hereby approves the cancellation of the November 22nd and December 27th regular meetings of the City Council this year.

BE IT FURTHER RESOLVED, that the City Council of the City of Mendota authorizes and directs the City Manager to execute all warrants necessary for the operation of the City during those times in which those regularly scheduled meetings would have occurred.

B. CFD No. 2006-1 Background
The Mello-Roos Community Facilities Act (“Act”) of 1982 came about as a response to the lack of adequate financing for public capital facilities and services in the post-Proposition 13 era. State Legislatures Mello and Roos sponsored this Bill, which was enacted into law by the California Legislature and is now Section 53311 et. seq. of the California Government Code. The Act authorizes a local government agency, such as a park district or a city, to form a Community Facilities District (“CFD”) within a defined set of boundaries for the purposes of providing public facilities and services. A CFD is formed for financing purposes only and is governed by the agency that formed it.

The City Council of the City of Mendota established CFD No. 2006-1 on November 28, 2006. The qualified electors within CFD No. 2006-1 authorized the City to levy a Special Tax to finance certain services, specifically to pay the costs of police and fire services within the community facilities district and in the surrounding area, and to pay costs associated with the determination of the amount of and the levy and collection of the special taxes.

C. Boundaries
CFD No. 2006-1 is located west of Hwy 33, north of Belmont Avenue, and bordered by Bass Avenue to the north and primarily Rowe Avenue to the east.

1 AGENDA ITEM – STAFF REPORT
TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: NANCY BANDA, FINANCE DIRECTOR
VIA: CRISTIAN GONZALEZ, CITY MANAGER
SUBJECT: AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE BACKUP GENERATOR

FUNDING PROGRAM AND AUTHORIZING THE CITY MANAGER OR CHIEF PLANT

OPERATOR TO EXECUTE ALL REQUIRED DOCUMENTS
DATE: OCTOBER 25, 2022
ISSUE
Shall the City Council adopt Resolution No. 22-67, authorizing the submittal of an application to the Backup Generator Funding Program and authorizing the City Manager and Chief Plant Operator to execute all required documents?

BACKGROUND
The State Water Resources Control Board will be accepting applications for the Backup Generator Funding Program from September 6 to December 9, 2022. The Backup Generator Funding Program provides backup generators to drinking water systems that do not have adequate backup electrical supply to ensure continuous operations during power failures.

Generator recipients must be a community water system that serves a small (less than 10,000 or less than 3,300 connections) disadvantaged (median household income (“MHI”) less than 80% of the statewide MHI, more than 50% of the homes are primary residences) community.

ANALYSIS
This grant funding is a wonderful opportunity for the City of Mendota (“City”) to take advantage of equipping our facilities with a backup generator to aid in emergencies. Earlier this fiscal year, the City Council approved a purchase of a standby generator, which was $242,200.00. The City will be constructing water storage and pump station on the west side of the city. If awarded this grant funding, the City will be able to utilize the backup generator at this site or at an existing site.

FISCAL IMPACT
None.

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 22-67, authorizing the submittal of an application to the Backup Generator Funding Program and authorizing the City Manager or Chief Plant Operator to execute all required documents.

TO: HONORABLE MAYOR AND COUNCILMEMBERS
FROM: MICHAEL OSBORN, PE – CITY ENGINEER
VIA: CRISTIAN GONZALEZ, CITY MANAGER
SUBJECT: 2022 LOCAL STREET RECONSTRUCTION
DATE: OCTOBER 25, 2022
ISSUE
Should the City Council adopt Resolution No. 22-68, awarding a construction contract for the 2022 Local Street Reconstruction Project to Emmett Valley Construction, Inc., in the amount of $784,742?

BACKGROUND
At the December 14, 2021 regular City Council meeting, the Council directed staff to prepare construction documents for the reconstruction of: 1) Riofrio Street from 7th Street to 8th Street; 2) Stamoules Street from 7th Street to 9th Street; and 3) Kate Street from Divisadero Street to I Street, (the “Project”).

Provost & Pritchard Consulting Group was retained to provide land surveying and engineering design services for the Project and they have prepared plans and specifications for bidding and construction of the project.

The Project has been coordinated with the City’s Police Station and Council Chambers project and will install necessary water services and street improvements in Riofrio Street.

The request for bids was initially advertised in The Business Journal and construction documents (plans and specifications) were made available to contractors through local Builder’s Exchanges on Friday, September 23, 2022. On Friday, October 14, 2022 at 2:00 p.m. the public bid opening was held in the City Council Chambers. Six general contractors attended and submitted bids, along with staff and the City Engineer. The bids were as follows:

CONTRACTOR BASE BID AMOUNT
Bush Engineering $929,339.50
Avison Construction, Inc. $891,083.00
Emmett Valley Construction, Inc. $784,742.00
Central Valley Asphalt $823,800.00
AGEE Construction $898,837.00
Dawson-Mauldin $1,003,472.50
2 ANALYSIS
These are three sections of the City street system that have been identified as being in failed condition and priority projects for use of Senate Bill 1/Road Maintenance and Rehabilitation Account (SB1/RMRA) funding.

We have reviewed the submitted bid packages. The apparent lowest bidder is Emmett Valley Construction, Inc. and their bid package was reviewed and found to be complete and responsive.

While not required, their bid does help achieve the City’s Disadvantaged Business Enterprise (DBE) goal of 2% by including a DBE subcontractor performing 8.7% of the project.

This project is scheduled to start on November 1, 2022 and will be completed in mid-December.

FISCAL IMPACT
These streets are functionally classified as “local” streets and are therefore not eligible for federal funding. The City intends to utilize their accumulated SB1/RMRA funds for delivery of this project. The total estimated project cost for this project was $1 million, and the bids received provide a good value to the City. The RMRA funds received to date are approximately $737,720 and by the end of Fiscal Year 2021/2022 this fund balance should be approximately $978,413; therefore, SB1/RMRA funds will be sufficient to completely fund this project. Use of the local Street Funds are included in the Fiscal Year 2022/2023 Budget. This project will not impact the General Fund.

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 22-68, awarding a construction contract for the 2022 Local Street Reconstruction Project to Emmett Valley Construction, Inc., in the amount of $784,742, and authorizing the City Manager or his designee to execute all documents necessary for the completion of the Project.

2 WHEREAS, Emmett Valley Construction, Inc., has performed responsibly on past projects for the City; and
WHEREAS, the proposed 2022 Local Street Reconstruction Project is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15302 (California Code of Regulations, Title 14, Section 15302) because it proposes to replace existing and fully-functional but deteriorated city streets with new improvements in the same location utilizing the same existing public right-of-way and serving the same function; not increasing the capacity of the street; and
WHEREAS, the City has sufficient Local Street funds available to fund the 2022 Local Street Reconstruction Project’s total construction cost.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mendota, that the City of Mendota awards the construction contract for the 2022 Local Street Reconstruction Project to Emmett Valley Construction, Inc., in the amount of $784,742.00 and authorizes the City Manager, or his designee, to execute all documents necessary for the completion of the 2022 Local Street Reconstruction Project.

SUBJECT: APPOINTMENT OF MENDOTA RESIDENTS TO THE PLANNING AND RECREATION

COMMISSIONS
DATE: OCTOBER 25, 2022
ISSUE
Should the City Council appoint Mendota residents to the Planning and Recreation Commissions?

BACKGROUND
The Mendota Planning and Recreation Commissions have recently had unexpected vacancies.

The Planning Commission currently has two (2) vacant positions (a regular position and the alternate position) and the terms of both positions run through January 31, 2023. The Recreation Commission currently has one (1) vacant position, and the term of the position runs through January 31, 2025.

A notice (attached to this report) was posted on October 6, 2022 notifying the public of the unscheduled vacancies, the terms of the available offices for appointment, the location of the application that is required to be completed, and the deadline (which was October 20, 2022 by 5pm) by which the application must be submitted to the office of the City Clerk.

ANALYSIS
A total of three (3) applications were received by the deadline for two (2) available positions on the Planning Commission (a regular position and an alternate position). The individuals who submitted applications are Josue Urias, Alex Garcia, and Kevin Romero and their applications are attached. Pursuant to Mendota Municipal Code (“MMC”) section 2.36.020, the Mayor selects individuals to appoint to the Planning Commission and the Council approves them.

Moreover, one (1) application was received by the deadline for the one (1) available position on the Recreation Commission. The application was submitted by Marcela Alonzo and her application is attached. Pursuant to MCC section 2.32.020, the City Council maintains the authority to appoint individuals to the Recreation Commission.

FISCAL IMPACT
