Mayor Martinez introduced the item and City Clerk Cabrera-Garcia provided the report.

A motion was made by Councilor Rosales to fill the City Council vacancy through an Minutes of City Council Meeting 3 January 10, 2023
application process with applications due Friday, January 20th at 12pm, and the final appointment occurring at the January 24th City Council meeting, seconded by Councilor Alonso; unanimously approved (4 ayes).

2. Council discussion and consideration of Resolution No. 23-05, appointing Council Members to various boards, commissions, and subcommittees.

Mayor Martinez introduced the item and City Clerk Cabrera-Garcia provided the report including the recent vacancies on various boards, committees, and sub-committees.

Discussion was held and decisions were made on what Council Members would fill what seats.

A motion was made by Councilor Rosales to approve Resolution No. 23-05, seconded by Mayor Pro Tem Lopez; unanimously approved (4 ayes).

DEPARTMENT REPORTS AND INFORMATIONAL ITEMS

1. Animal Control, Code Enforcement, and Police Department a) November Monthly Reports
Chief of Police Smith provided the report for the Code Enforcement department including the monthly log for the month of November.

Chief Smith provided the report for the Animal Control Department including animal control duties, violations, enforcement, and the issue of loose dogs in the City.

Discussion was held on the report provided by Chief Smith.

Finance Director Banda provided an update on various grants and programs.

a) Update
Assistant City Attorney Castro reported on ongoing projects and tasks.

5. City Manager
City Manager Gonzalez commented on the impact of the recent storms and stated that sandbags are available; provided a flood update; reported on a preconstruction meeting for the Council Chambers/Police Department project; and commented on potential businesses looking into coming to the City.

Discussion was held on floods and on the issue of certain residents losing their flood insurance.

MAYOR AND COUNCIL REPORTS AND INFORMATIONAL ITEMS

1. Council Member(s)
Councilor Rosales wished everyone a Merry Christmas and a Happy New Year and commented on the issue of speeding near Garcia St.

Councilor Alonso wished everyone a Happy New Year and cautioned staff to be careful; thanked Memorial Hospital Los Banos; thanked Sutter General Hospital in Sacramento; thanked staff; and wished his dad a happy birthday.

Mayor Pro Tem Lopez commented on the AMOR Wellness Center clinic closing and potential businesses that may take its place.

2. Mayor
Mayor Martinez thanked staff for their hard work; commented on elected officials that he met with and on future meetings for funding opportunities; commented on the Safe Routes to School Project; commented on a meeting to discuss funding for the homeless; and requested that City staff look into scheduling a joint meeting with the Mendota Unified School Board.

CLOSED SESSION

At 7:33 p.m. the Council moved into closed session.

At 8:00 p.m. the Council reconvened in open session and Assistant City Attorney Castro stated that in regard to item 1 of the Closed Session, there was no reportable action.

ISSUE
Should City Council adopt Resolution No. 23-06, appointing an individual to fill the vacant seat on the City Council?

BACKGROUND
Due to Mr. Rolando Castro’s resignation from the City Council effective December 13, 2022, there is a vacancy on the Mendota City Council. In response, the City Council elected to fill the vacancy by appointment. The vacancy was noticed, and an application acceptance period was held from January 11, 2023 to January 20, 2023.

ANALYSIS
During the application acceptance period a total of seven (7) applications were received from the following individuals: Ramiro Espinoza, John C. Flores, Jose “Lupe” Gallardo, Veronica Rasmussen-Gill, Moses Macias, Joseph R. Riofrio, and Kevin Arias-Romero. The applications are attached to this report for Council’s review and consideration. The applications have been redacted to remove certain personal information due to privacy reasons.

Although the vacant position has four (4) years left in its term, the appointment would only last until the November 2024 General Election. The seat would then be up for a two-year term in November 2024. In November 2026, the seat would go back to the usual four-year term.

The City Council has until February 11, 2023 to fill the vacancy by appointment. If the appointment doesn’t occur within 60-days of the resignation notice (December 13, 2022), the City Council will need to fill the seat through a special election, which would be a significant cost to the City.

FISCAL IMPACT
There is no fiscal impact.

RECOMMENDATION
Staff recommends that City Council review the applications received and adopt Resolution No. 23-06, filling the City Council member vacancy with one of the applicants. 2 Attachments:

WHEREAS, Rolando Castro resigned from the Mendota City Council by submitting a letter of resignation to the City Clerk; and
WHEREAS, pursuant to Government Code section 1770, subdivision (c), Mr.

Castro’s resignation from the City Council was effective upon delivery to the City Clerk on December 13, 2022; and
WHEREAS, Mr. Castro’s resignation from the City Council created a vacancy that must be filled within 60 days, or before February 11, 2023; and WHEREAS, pursuant to Government Code section 36512, subdivision (b)(2)(A), the City Council may appoint an individual to fill this vacancy and serve on the City Council until the November 2024 General Election.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mendota, that __________________ is appointed to serve on the City Council until the November 2024 General Election.

ISSUE
Which Mendota residents shall the City Council appoint to the Planning and Recreation Commissions?

BACKGROUND
Planning Commissioners Jose Gutierrez and Josue Urias and Alternate Planning Commissioner Alex Garcia will have their terms expire at the end of January. Pursuant to Mendota Municipal Code (“MMC”) section 2.36.020, the Mayor selects individuals to appoint to the Planning Commission and the Council approves them.

Furthermore, Recreation Commissioners Albert Escobedo and Josue Urias will also have their terms expire at the end of January, and the Commission is also carrying one vacancy. Pursuant to MMC section 2.32.020, the City Council selects individuals to appoint to the Recreation Commission.

A public notice (attached to this report) was posted on December 16, 2022 notifying the public of the vacancies, the term of the offices for appointment, the location of the application that is required to be filled out, and a deadline (which was Wednesday, January 18th) by which the application must be turned in to the office of the City Clerk.

ANALYSIS
Planning Commission
As a result of the upcoming term expiration date of January 31, 2023, there will be two (2) regular Planning Commissioner vacancies and one (1) Alternate Planning Commissioner vacancy. A total of five (5) applications were submitted for consideration. Jose Gutierrez, Josue Urias, and Alex Garcia each submitted applications for consideration for reappointment. Albert Escobedo and Kevin Romero also submitted applications for consideration of appointment.

Recreation Commission
As a result of the upcoming term expiration date of January 31, 2023, there will be three (3) regular Recreation Commissioner vacancies. A total of three (3) applications were submitted for consideration. Albert Escobedo submitted an application for consideration for reappointment. 2 Alicia Escobedo and Kevin Romero also submitted applications for consideration of appointment.

In summary, five individuals applied for the three available positions on the Planning Commission (two regular Commissioner positions and one alternate Commissioner position), and three individuals applied for the three available positions on the Recreation Commission.

The applications are attached to this report for Council’s review and consideration. The applications have been redacted to remove certain personal information due to privacy reasons.

FISCAL IMPACT
None.

RECOMMENDATION
Staff recommends that the Council take two separate actions:

1. Mayor Martinez appoints residents to the two regular Planning Commissioner positions and a resident to the one alternate Planning Commissioner position, with the approval of the City Council; and

2. City Council appoints residents to the three regular Recreation Commissioner positions.
