RECOMMENDED ACTION
1. Adopt a resolution declaring the results of the November 8, 2022 General Municipal Election and reciting such other matters as provided by law.
DISCUSSION
In a consolidated election, California Elections Code section 10262(b) states that upon receipt of the results of the election from the Riverside County Registrar of Voters (ROV), the City Elections Official shall certify the results to the governing body. This action must take place not later than the next regularly scheduled city council meeting following presentation of the 28-day canvass of the returns, or at a special meeting called for this purpose. The City received the final vote count from the ROV on December 6, 2022, dated December 1, 2022. The results are attached.
Per Elections Code section 10263, the City Council shall adopt a resolution reciting the facts of the election and declare elected persons for whom the highest numbers of voters were cast for each office before installing the new officers.
In District 2, Ricky Estrada received the highest number of votes.
Pursuant to Elections Code Section 10229 the City Council held a special meeting on August 24, 2022 to consider the appointment of Incumbent Dean Deines. As Dean Deines was the only District 4 candidate to apply and qualify for the November 8th election, and there were no other city-wide actions to be placed on the ballot as it related to the City of Menifee, District 4, the City Council had the option to cancel the election for District 4 and appoint the qualified candidate.
The City Council adopted Resolution No. 22-1199 and appointed Dean Deines as the District 4 Councilmember. Pursuant to Elections Code Section 10229 Councilmember Deines shall serve exactly as if elected at the municipal election.

RESOLUTION NO. 22-____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA,
RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, DECLARING THE RESULTS OF THE ELECTION AND RECITING
SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of Menifee, California, on Tuesday, November 8, 2022, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law for candidates; candidates were nominated to fill the offices as provided by law; voting precincts were properly established; election officers were appointed; and in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the laws of the State of California relating to general law cities; and
WHEREAS, in compliance with Resolution No. 22-1171, adopted June 15, 2022, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results to the City Council; and
WHEREAS, pursuant to Elections Code Section 10229 the City Council adopted Resolution No. 22-1199 and appointed Dean Deines as the District 4 Councilmember; and WHEREAS, pursuant to Elections Code Section 10229 Councilmember Deines shall serve exactly as if elected at the municipal election; and
WHEREAS, the results of the election are received, attached and made a part hereof as Exhibit A.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
1. That the whole number of ballots cast in the City was 17,089.
2. That the names of persons voted for at the election for Member of the City Council Term Ending December 2026 are as follows:
District 2 – Ben Diederich
Angela “Angel” Nevin
Ricky Estrada
Altie Holcomb
3. That the City Council does declare and determine that:
Ricky Estrada was elected as Member of the City Council for the full term of four years, for District 2 - ending December, 2026.
4. The City Clerk shall enter on the record of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; and the Item Title: 5.1

5. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the office of Member of the City Council to which they have been elected.
6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

RECOMMENDED ACTION
1. Discuss and appoint City Council representatives to Regional Boards and Commissions and other appointments by Mayor Zimmerman and ratified by the City Council as required by City Council Policy No. 2.
2. Amend City Council Policy No. 2, City Council Standing Committees, Regional Boards and Regional Commissions – Assignments and Reporting to reflect the addition of the City & School Districts Committee and the dissolution of the Public Safety Committee.
DISCUSSION
During the annual City Council reorganization, the City Council reviews its representatives and alternates to various regional boards and commissions to determine if any changes or additions are appropriate as stipulated in City Council Policy No. 2. Attached is a list of agencies to which the City Council members are currently representing the City and vacancies available.
Also presented for ratification is an amendment to City Council Policy No. 2 to reflect changes to the standing City Council sub committees previously adopted by the Mayor and City Council.
These changes include the addition of the City & School Districts Committee established on June 17, 2020; and the dissolution of the Public Safety City Committee on May 19, 2021.
Following the City Council’s selection of representatives, the City Clerk will notify the various agencies of any changes.

1.0 PURPOSE
The purpose of this Policy is to provide for annual confirmation or adjustment of Council member appointments to Council standing committees, Regional Boards and Regional Commissions and to establish regular and routine communication of the actions of such Regional Boards and Regional Commissions by the representatives to them.
2.0 SCOPE / BACKGROUND
The scope of this policy applies to all elected and appointed officials representing the City of Menifee on various committees, commissions, or boards.
3.0 POLICY
The City Council annually, or otherwise as necessary, assigns its Members to various City Standing Committees as well as Regional Boards and Regional Commissions where a City representative and alternate is required. These Standing Committees, Regional Boards and Regional Commissions meet at different times of each month or year. The chair of each Standing Committee will report its recommendations and actions at each Council Meeting. Likewise, the responsibility for communicating the City’s interests rests with each individual City Council Member who will report after each meeting of the Regional Board or Regional Commission, whenever scheduled, or otherwise as necessary to update or obtain consent from the City Council for any position to be taken by the Council, or other action of the Council as appropriate.
Designation of Standing Committees: The City Council hereby creates the following Standing Committees that shall have duties as provided in this Policy or otherwise determined by the City Council. Each Standing Committee shall consist of two Council members appointed as set out in this Policy.
A. Finance and Investment Committee, which will study matters relating to budget, financial impacts, and investments and make recommendations to the Council as a whole.

B. Public Safety Committee which shall study matters relating to law enforcement, fire prevention and protection, emergency services, and animal control and make recommendations to the Council as a whole. (dissolved 5-19-21)
B. City & School Districts Committee, which meets annually to collaborate on common issues that impact schools and the city (created 6-17-2020).
In addition to such Standing Committees, the Mayor from time to time may create ad hoc committees and appoint two Council members to each such ad hoc committee.
4.0 PROCEDURE
Annually, at the Council’s organizational meeting (the first meeting in December or other date as determined by the Council), the City Council shall review Standing Committee, Regional Boards and Regional Commission assignments.
No later than two weeks before that meeting the City Clerk shall circulate a list of Standing Committees, Regional Board and Regional Commissions showing the duties, compensation, meeting times and the current Council representative and alternate.
In advance of the organizational meeting, each Council member (as an informational matter), shall indicate on that list whether he or she wishes to remain on the same Standing Committees, Regional Board or Regional Commission or whether he or she wishes to change. Each Council member then shall provide a copy to the City Clerk.
Along with the agenda materials for the organizational meeting, the City Clerk shall provide the list with any annotations from Council members.
Appointment:
The Mayor shall be responsible for appointing the Council representatives to each Standing Committee, Regional Board or Regional Commission, including the Mayor himself or herself.
In the event that no Council members indicate an interest in a Standing Committee, Regional Board or Regional Commission, the Mayor may appoint a Council member.
The appointments shall be made by the Mayor and the Council shall ratify such appointments by majority vote.
All assignments take effect January 1 of the following year. Notwithstanding, such assignments may also be reviewed and/or changed throughout the year as the need arises. A representative or alternate may be removed without cause and without his or her consent by majority vote of the City Council.
City Council meetings are the avenue for City Council Members to report on their various assignments. Standing Committees, Regional Boards and Regional Commissions will be listed on the City Council agenda under the name of the representative.
