The Potomac and Meadows Resurfacing Project consisted of resurfacing existing roads with chip seal/slurry seal, restriping, and reconstruction of 22 non-compliant ADA ramps. The work was performed in the Menifee Meadows neighborhood, east of Bradley Road and north of Holland Road, and in the Potomac neighborhood located east of Bradley Road and north of Potomac Drive, as depicted in the Project Location Map. The Project was completed in two parts, beginning with a crack seal of the project area followed by the final resurfacing by chip seal/slurry seal throughout both neighborhoods. Services for crack seal were performed under a separate contract. The Project resurfaced approximately 7.5 miles collectively between both neighborhoods.

On April 6, 2022, the City Council approved a total construction budget of $878,473 and authorized the City Manager to approve the construction contract with Pavement Coatings, Inc. (Contractor) in the amount of $756,613 to complete the slurry seal resurfacing improvements for the Project. The final construction costs for the Project totaled $866,718.33, including crack seal services and ancillary costs such as materials testing and labor compliance services.

If approved, a Notice of Completion (NOC) would be filed, which protects the City from future claims against the Project by providing proper noticing to each contractor, subcontractor, and material supplier, that the Project has been completed. The payment bond should be released upon project acceptance by the City and the performance bond would be released one-year after the date of recording of the NOC. The City has not received stop notices that would prevent said releases.

CITY OF MENIFEE
SUBJECT: Final Map, Subdivision Improvement Agreement and Bonds for Tract Map 36937, The Village, by Century Communities of California, LLC.

MEETING DATE: February 1, 2023
TO: Mayor and City Council
PREPARED BY: Andrew Walle, Assistant Engineer
REVIEWED BY: Nick Fidler, Public Works Director
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Approve and authorize the filing of final map 36937, The Village, by Century Communities of California, LLC, at the south-east corner of Barnett Road and McLaughlin Road; and

2. Approve and authorize the City Manager to execute the Subdivision Improvement Agreement to guarantee completion of required public improvements associated with Tract Map 36937.

DISCUSSION
Tract Map (“TM”) 36937, also known as The Village (“Project”), is a proposed subdivision of 15.93 gross acres of land into one lot for condominium purposes to accommodate 126 residential condominium units. The Project is located west of the I-215 Freeway, at the south-east corner of Barnett Road and McLaughlin Road.

Century Communities of California, LLC. (“Developer”) is now requesting approval and filing of the final map for Tract 36937 and approval of the associated Subdivision Improvement Agreement (“SIA”) as required by the Project’s conditions of approval. The SIA requires that improvement securities are posted to guarantee the completion of the required onsite and offsite improvements.

The SIA requires that public improvements be completed within 12 months from the date of City Council approval.

Staff has reviewed the Developer’s request and determined that the SIA meets the requirements of the Project’s conditions of approval. A summary of the bonds being posted to guarantee the required improvements are shown in the tables on the following page.

CITY OF MENIFEE
SUBJECT: Acceptance of Public Improvements, Cortana Basin in Menifee Town Center, Parcel 22 of Parcel Map 36299-1, by Lennar Homes of California, Inc.

MEETING DATE: February 1, 2023
TO: Mayor and City Council
PREPARED BY: Chet Robinson, Senior Engineer
REVIEWED BY: Nick Fidler, Public Works Director
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Accept the public improvements of the Cortana Basin located within Parcel 22 of Parcel Map 36299-1 in Menifee Town Center, located south of Newport Road and west of Haun Road.

DISCUSSION
Menifee Town Center is a mixed use development with residential, retail, office and hotel components, located south of Newport Road and west of Haun Road. Parcel Map 36299-1 divided approximately 129 acres into 26 parcels within Menifee Town Center. As part of the Conditions of Approval, the developer for the adjacent Tract Map 37179, Lennar Homes of California, was conditioned to construct the Cortana Club and the Cortana Basin within Parcel 22 of PM36299-1.

The Cortana Basin collects stormwater from portions of Civic Plaza Drive, City Hall Drive, and Park Plaza Avenue prior to discharging into the Paloma Wash.

The developer has completed construction of the Cortana Basin and is requesting that the City accept the improvements into the City’s maintenance system. The Public Works/Engineering Department has inspected the Cortana Basin and determined that the basin has been completed in accordance with City specifications and standards.

Imagine the City of Menifee as a finely-tuned clock, with three gears working together to ensure premier performance. These significant gears, which keep our organization thriving, are our and of programs and services. The City’s Mission is to provide essential services that improve our community’s quality of life through teamwork and leadership. The Mission is followed by our Strategy which stems from countless collaborative efforts and plans developed by City departments including our award-winning balanced budget, thoughtful Capital Improvement Program, and goal-oriented Strategic Plan.

These strategic efforts have resulted in the Implementation of supreme programs and services for our residents and businesses.

So, what keeps our gears turning? Menifee’s
Whether it be housing, commercial and industrial square footage, or recreation, development continues to drive our City and is the heart of this year’s Annual Report.

In 2022, our Economic Development Team continued to connect with developers, businesses, and investors which resulted in securing the largest land deal in Chick-Fil-A’s history to date, attracting four new hotels, and spurring over 12 million square feet of industrial development in the Northern Gateway. The Economic Development Team's notable connections fulfilled our strategic goal of a which kept the gears moving for our Community Development Department. Throughout the year, City staff processed 262 planning applications, 883 New Single-Family Residence permits, over 5,000 building permits, and conducted more than 28,000 inspections.

Development continued throughout the City with its Public Works Department completing multiple large-scale projects including the resurfacing of City streets, enhancements to the Paloma Wash Trail, and major renovations at the Lazy Creek Recreation Center. Working in collaboration with Congressmen Calvert’s office, the City’s Legislative Team was able to secure $5 million in federal funding to support the Bradley Bridge over Salt Creek project. These infrastructure projects achieved the strategic goal of an
Speaking of funding, our Finance Team completed an update to the Citywide User Fee Study and Development Impact Fee (DIF) Study adopting new fee schedules, which will capture additional revenue to continue to advance infrastructure. In addition, the team updated the City’s Business License Ordinance and issued 3,924 business licenses which included NEW businesses.

New city-wide programs were also launched this year including the Passport Program managed by the City Clerk’s Office which provides residents with local access to United States passport services. The Office of the City Clerk also completed over 600 public records requests and helped to manage the November 2022 General Municipal Election, further helping the City achieve its strategic goal to be a
In addition, the Community Services Department gathered public input for the City’s Parks Master

Plan Update. The team also opened three new parks, totaling 11 acres, including the largest bike park in Southern California (Gale Webb Action Sports Park).

Public Safety continues to remain a high priority for the City. In December, the City broke ground on the new Quail Valley Fire Station #5, as well as expanded safety equipment and personnel with an additional medic squad, totaling two medic squad units.

Menifee's Police Department continued to work on the strategic goal of making Menifee a by hiring additional police personnel and
conducting community outreach efforts in multiple districts to enhance public safety.

These projects, programs, and services would not be possible without the internal gears that keep the City running. To effectively serve Menifee’s growing population which has reached over 106,000 residents, our workforce has grown to 319 employees thanks to the tireless recruiting efforts of our Human Resources Department. I had the privilege of recognizing our City’s efforts to strengthen employee retention first-hand at the International City/Council Management Association (ICMA) annual conference, where I presented an internal development tool “Menifee University: Attracting, Retaining, and Growing Employees”. This year has also shed light on the importance of cybersecurity. Our Information Technology Department held a citywide cybersecurity training to ensure our staff recognizes potential cyber threats. That effort has resulted in blocking and preventing over 154 million attacks in our City’s information technology system.
2022 was a year of growth and development, to say the least. I am proud to share that the year ended with many noteworthy accolades, including the Government Finance Officers Association’s (GFOA) Distinguished Budget Presentation Award, the 2022 Excellence Award from the International Economic Development Council (IEDC), and the Building Industry Association (BIA) - Riverside Chapter's Excellence in Government Service Award. Menifee was also named Best City by Inland Empire Magazine and voted Top Workplace by the Inland News Group for the fourth consecutive year. These would not be possible unless our most valued asset, "our City employees", gave their unwavering commitment and dedication to our organization.

As the City’s gears turn in unison and goals are accomplished, I'd like to thank you all for your continued trust and support. Your patience, understanding, and willingness to ask the hard questions, allow us to improve our community’s quality of life and provide a and place to be.

Respectfully,
Armando G. Villa

CITY OF MENIFEE
SUBJECT: Waste Management Senior Bill Assistance Program Review MEETING DATE: February 1, 2023
TO: Mayor and City Council
PREPARED BY: Kori Jones, Senior Management Analyst
REVIEWED BY: Jonathan Nicks, Community Services Director APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Review Senior Bill Assistance Program and provide direction to staff regarding modification, extension, or continuation until funds are exhausted.

DISCUSSION
California Senate Bill 1383 (SB 1383) requires households and most businesses to separate organic waste such as food scraps and yard waste into their green organics bin. These items are then recycled into compost and thus diverted from state landfills. California has a lofty goal of reaching 75% diversion of organic materials from landfills by 2025. As such, local jurisdictions have been tasked with ensuring implementation, education, outreach, and compliance of the state mandate.

In April 2022, the City negotiated with Waste Management to phase in the costs of collecting and processing residential organics over a two-year period for regular residential accounts and a three-year period for accounts designated as senior accounts. To additionally off-set the cost increase to the Menifee senior community, the City Council approved a Senior Bill Assistance Program as part of the Fiscal Year 2021/2022 mid-year budget in the amount of $150,000. The one-time $50 credit has been made available to Menifee residents over the age of 60 who furnish proof of residency and a recent Waste Management bill to the Community Services Department.

As of January 2023, the Program has approved 2,645 one-time bill credits or $132,250, leaving $17,750 remaining in the Program budget.

Staff requests that Council review the Program and provide direction on extending or concluding the program once funds have been exhausted. If extended, the Program will continue to be available to Menifee seniors where it is estimated there are an additional 3,000 households that have not applied for assistance. Funding to extend the Program for seniors who have not already applied for the one-time bill credit is estimated at $150,000. This estimate does not include the Item Title: 12.1

potential for senior residents who have already taken advantage of the bill credit, to reapply for a second $50 credit.

The City is not required to off-set the costs of waste bill increases attributed to the state law and is on-track with compliance in areas mandated under SB 1383 which include collection, reporting, capacity planning, edible food recovery, outreach/education, and enforcement.

STRATEGIC PLAN OBJECTIVE
Responsive and Transparent Community Government

FISCAL IMPACT
Should City Council provide direction to continue the Senior Bill Assistance Program beyond the originally budgeted $150,000, an additional appropriation to account 100-4661-52852 will be required based on the parameters of the extension of the Program.

CITY OF MENIFEE
SUBJECT: Consideration of Change to the Governance Structure MEETING DATE: February 1, 2023
TO: Mayor and City Council
PREPARED BY: Rebekah Kramer, Assistant to the City Manager REVIEWED BY: Rochelle Clayton, Assistant City Manager
APPROVED BY: Armando G. Villa, City Manager

RECOMMENDED ACTION

1. Review, discuss and provide staff direction regarding consideration of a change in the City’s governance structure; transitioning from four City Council districts with an at-large, elected Mayor, to five City Council districts and a rotating Mayor.

DISCUSSION
Governance Structure
The City of Menifee is a General Law City governed by the California Government Code. As stipulated under the City of Menifee’s Municipal Code Sections 2.04.070 and 2.32.010, the City is currently divided into four City Council districts and with a mayor elected on a citywide (at-large) basis. On September 21, 2022, Councilmember Karwin, with a second from Councilmember Sobek, requested that staff prepare a future agenda item to allow the Mayor and City Council to discuss the possibility of transitioning to a governance structure that includes five City Council districts and a rotating mayor.

Background
The City’s existing governance structure was established by voters on November 2, 2010, (Ordinance 2010-87). On November 6, 2018, voters in the City of Menifee considered a ballot measure to create five Council districts, eliminate the office of the mayor at-large, and provide for the selection of the mayor from among the five Councilmembers (Measure I). With less than half of voters in support, the Measure did not pass. The cost associated with placing Measure I on the ballot in 2018 was close to $12,000; based upon the population growth and election cost increases that have occurred in the last five years, it is anticipated that a ballot measure included as part of the next general election would exceed $30,000.

In adherence with the California Elections Code, the City Council district boundaries must be reviewed every 10-years following the completion of the United States Census to ensure that each district has substantially the same number of residents. The Council District boundaries were reviewed and updated on March 2, 2022, following completion of the 2020 Census. The City engaged Bear Demographics and Research to facilitate the last redistricting process including community outreach and engagement at a cost of $64,000. A transition to five Council districts and a rotating mayor, would require the City to initiate a redistricting process to ensure that the population of each district remains substantially balanced.

Next Steps
Should the Mayor and City Council decide to place a measure on the next general election ballot for voters to consider a change in the City’s governance structure, funding will need to be allocated for the ballot initiative as well as the redistricting process. Staff is seeking Mayor and City Council direction prior to conducting further analysis and preparing the draft documents needed for voters to consider a ballot measure that would change the City’s existing governance structure.

STRATEGIC PLAN OBJECTIVE
Responsive and Transparent Community Government

FISCAL IMPACT
