CITY OF MENIFEE
SUBJECT: Development Code Amendment to Implement Housing Element Program Action 5
MEETING DATE: April 5, 2023
TO: Mayor and City Council
PREPARED BY: Doug Darnell, Principal Planner
REVIEWED BY: Cheryl Kitzerow, Community Development Director APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------
RECOMMENDED ACTION
1.Find that Code Amendment No. LR23-0017 is exempt from further environmental review pursuant to Section 15061 (b)(3) “Common Sense Exemption” of the California Environmental Quality Act (CEQA) and 14 CCR 15168 (c)(2) based on the City’s previously certified 6th cycle, 2021-2029 Housing Element Project Final Program Environmental Impact Report, and direct staff to file a Notice of Exemption; and
2.Introduce an Ordinance approving Code Amendment No. LR23-0017, to amend Chapter
9.130.030 of the Development Code (Title 9 of the Menifee Municipal Code) to add provisions to for by-right review of residential projects with a minimum of 20% of the units affordable to lower income households and located on candidate sites identified in the current Housing Element and used in a prior housing element as required to implement Housing Element Program Action 5 and comply with State law.
DISCUSSION
The City Council initially adopted the City’s 2021-2029 Housing Element on December 15, 2021; however, after adoption, subsequent review and revisions to the Housing Element were required by the Department of Housing and Community Development (HCD) to comply with State Housing Element law. Once all HCD required revisions were completed to HCD’s satisfaction, the City Council re-adopted the Housing Element on November 16, 2022.
On November 22, 2022, the City submitted the re-adopted Housing Element to HCD for their review with the goal of receiving HCD’s final approval and certification. On January 19, 2023, the Item Title: 11.3

City received a letter from HCD determining that the City’s Housing Element could not be found in full compliance until Housing Element Program 5 is completed.
The proposed Code Amendment supports the State’s housing goals to facilitate and remove barriers to housing, particularly affordable housing, and has been prepared in response to HCD’s determination letter as necessary to comply with State law. The City must adopt the amendment to obtain a determination by HCD that the City’s Housing Element complies with State Housing Element law (i.e., a “full compliance” determination letter). HCD staff has reviewed the City’s draft amendment and has indicated that, when adopted, the amendment will satisfy completion of Program Action 5.
Planning Commission Hearing – March 8, 2023
At the March 8, 2023, Planning Commission meeting, the Planning Commission voted 5-0 to adopt a resolution recommending that the City Council find Development Code Amendment No.
LR23-0017 exempt from further environmental review and approve the proposed Development Code Amendment LR23-0017.
Project Description
This proposed City initiated Development Code amendment adds provisions to the Development Code to implement Program Action 5 of the City’s 2021-2029 Housing Element as required to comply with State law and achieve full compliance for the Housing Element. Specifically, language is added to Chapter 9.130.030 for residential projects with a minimum of 20% of the units affordable to lower income households. This applies to non-vacant sites identified in the Housing Element to accommodate the City’s lower income portion of the City’s Regional Housing Needs Allocation (RHNA), and which were also used in the City’s prior 5th cycle Housing Element. The proposed amendment references Figure B-1 and Table B-12 in Appendix B of the Housing Element for a list of these sites, which are generally located in the northeasterly portion of the City, north of Watson Road between Sherman and Antelope Roads, east side of Antelope Road, south of Watson Road, and one site located on the west side of Menifee Road and northerly of Rouse Road. All these sites/parcels are zoned as High Density Residential (HDR) allowing for a density deemed sufficient to accommodate the lower income portion of the RHNA (i.e., units required to be accommodated by the City). Per State law, a 20% affordable housing project on these non- vacant sites shall be by-right and shall not require discretionary review that would constitute a “project” under CEQA. However, the law allows the City to require such project to be subject to objective design/development standards (i.e., the City’s Multifamily Objective Design Standards) and such project would need to comply with all applicable City requirements, development standards and codes, provided they are objective and do not involve discretionary review.
In addition to the above-described provisions for non-vacant sites, provisions are added for 20% lower income projects on vacant sites that may be identified as part of a future housing element to accommodate the lower income portion of the RHNA and which were used in two prior housing elements.

Environmental Determination
Staff has reviewed the proposed Code Amendment in accordance with the CEQA Guidelines and has determined that the Code Amendment is exempt pursuant to Section 15061 (b)(3) “Common Sense Exemption” of the CEQA Guidelines, as the proposed Code Amendment is required to implement Program Action 5 of the City’s adopted 6th cycle, 2021-2029 Housing Element and to comply with state law. The Code Amendment involves provisions that only affect the review process (i.e., by-right review), for 20% lower income residential projects on certain candidate sites identified in the Housing Element and used in a prior housing element, and as required by Government Code section 65583.2(j), such use shall be by-right and shall not require discretionary review that would constitute a “project” as defined in Section 21000 of the Public Resources Code (CEQA). Therefore, it can be seen with certainty that there is no possibility that the proposed amendments will have a significant impact on the environment.
Additionally, the proposed Code Amendment implements Program Action 5 of the City’s adopted 6th cycle, 2021-2029 Housing Element of the General Plan. On December 15, 2021, the City Council adopted Resolution No. 21-1110 adopting the Final Programmatic Environmental Impact Report (FPEIR) for the Housing Element Update Project (State Clearinghouse No. 2022010031) (Project). Pursuant to California Code of Regulations section 15168 (c)(2), when an agency adopts a program EIR, it does not need to prepare an additional environmental document for subsequent activities if the activity is within the scope of the program EIR. Based on data and analysis and findings of the FPEIR, the Project would not directly result in significant adverse environmental impacts and was already contemplated by the FPEIR. All potential impacts were determined to be less than significant without mitigation or can be reduced to a less than significant level with implementation of the mitigation measures identified in the FPEIR.
Additionally, no cumulative significant impacts were identified in the FPEIR based on findings that the Project’s contributions to such impacts are considered not to be cumulatively considerable.
Therefore, the adoption of the proposed Code Amendment would also be exempt pursuant to California Code of Regulations section 15168 (c)(2).
Findings
Findings for approval of the Code Amendment are included in the attached proposed Ordinance.
Public Notice

The proposed amendment complies with the California Environmental Quality Act (CEQA) and is determined to be exempt pursuant to Section 15061(b)(3) “Common Sense Exemption” of the CEQA Guidelines, as it can be seen with certainty that there is no possibility that the proposed amendments will have a significant impact on the environment as follows: 1) the proposed Code Amendment is required to implement Program Action 5 of the City’s adopted 6th cycle, 2021-2029 Housing Element and to comply with State law; 2) the Code Amendment involves provisions that only affect the review process (i.e., by-right review) for 20 percent lower income residential projects on certain candidate sites identified in the Housing Element and used in a prior housing element; 3) as required by Government Code section 65583.2(j), such use shall be by-right and shall not require discretionary review that would constitute a “project” as defined in Section 21000 of the Public Resources Code (California Environmental Quality Act “CEQA”); and 4) the proposed Code Amendment implements Program Action 5 of the City’s adopted 6 th cycle, 2021-2029 Housing Element of the General Plan.
In addition, the proposed amendment is also exempt from CEQA pursuant to California Code of Regulations section 15168 (c) (2), which provides that when an agency adopts a program EIR, it does not need to prepare an additional environmental document for subsequent activities if the activity is within the scope of the program EIR. On December 15, 2021, the City Council adopted Resolution No. 21-1110 adopting the Final Programmatic Environmental Impact Report (“FPEIR”) for the Housing Element Update Project (State Clearinghouse No. 2022010031) (“Project”). Based on data and analysis and findings of the FPEIR, the Project would not directly result in significant adverse environmental impacts.
SECTION 8.
If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, then such decision shall not affect the validity of the remaining portions of this Ordinance. CITY OF MENIFEE
SUBJECT: Agreement with Dokken Engineering for a Feasibility Study of the Salt Creek Trail Construction and Maintenance
MEETING DATE: April 5, 2023
TO: Mayor and City Council
PREPARED BY: Nancy Rodriguez, Management Analyst
REVIEWED BY: Jonathan Nicks, Deputy City Manager
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------
RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Professional Services Agreement with Dokken Engineering for a Feasibility Study of the Salt Creek Trail construction and maintenance in the amount not to exceed of $141,735; and
2. Adopt a Budget Amendment Resolution authorizing the appropriation of expenditures in the amount of $41,735 from available Community Services Department operating funds to account no. 512-4555-58147.
DISCUSSION
The City of Menifee’s Community Services Department in collaboration with the Riverside County Regional Park and Open-Space District (RivCo Parks) desire to develop options for extending the current multi-use trail along the Salt Creek Trail. Approximately 4.1 miles of the Salt Creek Trail was paved in 2020 extending from Goetz Road to Antelope Road; however, there is an unofficial user created dirt portion located behind the WellQuest Facility and Oasis Development that expands approximately 1.6 miles.
On June 15, 2022, Council authorized the City Manager to execute a Cooperative Agreement with RivCo Parks for the connectivity and maintenance Feasibility Study of the Salt Creek Trail.
The Study would help the City better understand the viability of creating a trail extension, maintenance of the trail, the trail’s ability to meet the needs of the community, and to provide recommendations on next steps for trail development.

RivCo Parks notified City staff that the Agreement experienced a temporary delay in execution.
On November 29, 2022, Riverside County Board of Supervisors approved the Cooperative Agreement with the City of Menifee that outlined RivCo Parks’ commitment to contribute $100,000 towards the Feasibility Study of the connectivity and maintenance of the Salt Creek Trail.
On November 14, 2022, staff issued Request for Proposal (RFP) No. 2023-10 for a comprehensive Feasibility Study for construction and maintenance of the Salt Creek Trail. After not yielding any results, staff reached out to potential bidders to gain some insight on why no responses were submitted and determined that time constraints to develop the proposals were the biggest concern. On January 11, 2023, staff re-issued (RFP) No. 2023-10B.
The Study would include, at minimum, the following:
1. The recommendation of a preferred layout for a multi-use pedestrian trail based on an assessment of the existing conditions, land use constraints, existing property easements, transportation and access considerations, and public input; and
2. A feasibility study report that provides consideration and recommendations for access parking impacts and options, best design standards and requirements for a multi-use trail, proposed mitigation plan, construction phasing, and a preliminary cost estimate for each.
The City received three proposals from the following firms:
•Community Works Design Group
•Dokken Engineering
•Michael Baker International
An evaluation committee consisting of City staff evaluated the submittals. As part of the City’s RFP process, the firms were evaluated based on the criteria set forth in RFP 2023-10B which included the experience/qualifications of the firm, work plan methodology/project approach, delivery schedule and timeline, cost proposal, reference review, and the quality of responsiveness of the proposal.
Following the evaluation process and reference checks, City staff determined that Dokken Engineering was the most qualified to conduct the requested services.
All the tabulated results from the evaluations are listed in Table 1 below:

FISCAL IMPACT
The Cooperative Agreement with RivCo Parks included a transfer of $100,000 in remaining Salt Creek Trail Project funds to the City of Menifee for the purpose of the Study. However, all three proposal received were greater than this amount and the selected proposal amount was $141,735. Given that the existing budget is $100,000, additional funding in the amount of $41,735 would be required to fully support the Project as summarized in Table 2.

Staff is requesting the additional allocation of $41,735 to account 512-4555-58147 from available fund balance in Fund 512 DIF 17 – Trails, to bring the total project funding to $141,735.

RECOMMENDED ACTION
1.Discuss the creation of historic districts and the preservation of rural areas; and
2.Provide direction to City staff.
DISCUSSION
Background
On May 4, 2022, the City Council requested a future agenda item to discuss the creation of historical districts and preserving rural areas.
Historic Preservation/Historic Districts
The City currently does not have a historic preservation ordinance or any historic districts.
However, local jurisdictions in California have the authority to adopt a local ordinance with regulations for protecting historic properties.
Historic preservation ordinance provisions may apply to individual structures, features, landmarks, or sites, and/or may apply to a district or defined geographic area. A local historic district is an entire area or group of historic structures, features, landmarks, or sites deemed significant to a city's cultural fabric that are protected by public review. They are typically downtown commercial areas, main streets, and residential neighborhoods, and could potentially include rural areas.
Understanding local preservation goals is a crucial first step in the drafting process, and every effort should begin with a clear and succinct purpose statement. •What is the historic value that the community wishes to preserve and where is it? Item Title: 12.2

1. Receive and file an update on the 2022 Education Summit.
DISCUSSION
Background
The City & School Districts Committee was formed in 2020 and is charged with convening an annual Education Summit with school representatives to share information and identify ways the City and schools can work in collaboration to address shared issues. Councilmember Lesa Sobek and Mayor Pro Tem Bob Karwin are currently serving as the City Council’s appointed representatives on the Committee.
The 3rd annual Education Summit was held on October 27, 2022, with representatives from Menifee Union School District (MUSD), Perris Union High School District (PUHSD), Romoland School District, Santa Rosa Academy, Springs Charter Schools, and Mt. San Jacinto College (MSJC). The focus of the 2022 Education Summit centered around ways the City and schools can work together in their respective roles to support and promote safety in the community. Each representative discussed common safety measures impacting the City and schools including safe routes to schools, online threats, safety programs and services provided to students.
The City Manager and Director of Public Works provided an overview of growth and development occurring citywide including new housing developments and public infrastructure projects that will support safe routes to school. Street maintenance improvements highlighted included roadway striping, crosswalk and bike lane designations, and signage (i.e., no parking, stop signs, school zones, and pedestrian crossing warnings). The capital road and traffic signal improvements taking place near schools located within the City were also referenced including the Normandy Road pedestrian improvements (CIP 22-08), Bell Mountain Safe Routes to School Project (CIP 22-25), Item Title: 12.3

as well as four new traffic signals scheduled for completion by April 2023, including the signal at Menifee Road/Garbani Road (CIP 21-11) identified as an area of concern for MUSD.
Menifee Police Department’s (PD) Chief of Police provided an update on the deployment of school resource officers (SROs), traffic enforcement around schools, and response to electronic communication challenges (school threats and cybercrimes). Full-time SROs are currently based at both Paloma Valley and Heritage High Schools and discussions are underway with the MUSD and Romoland School Districts regarding the feasibility of adding SROs at some of their school sites.
The Fire Division Chief provided an overview of the City’s plan to enhance fire protection services, the expansion of Fire Station 68, replacement of Station 5, and safety training program (Cardiopulmonary Resuscitation (CPR), Automated External Defibrillator (AED), and first aid) courses available to schools and the broader community.
School representatives highlighted the various programs and services they are utilizing to address safety related issues on campuses. MUSD and Romoland School District are working in collaboration with the Menifee PD to coordinate messaging between the City, District, and other responding agencies when an incident or school lockdown occurs. MSJC installed monitoring cameras and added Riverside Sheriff Officer patrols on campus to proactively identify and respond to safety related issues. They have also expanded their Emergency Medical Technician and Fire Technology Programs to help build the workforce of the future. PUHSD has implemented wellness programs and hired more social workers and counselors to address the increased volume of students requiring mental health services. Santa Rosa Academy increased staffing to assist with mental health support services and is providing CPR classes as part of its physical education curriculum. They also installed sensors in bathrooms to alert staff when students are in distress.
The Committee invited the school representatives to share their top safety-related priorities to address in collaboration with the City. The identified areas of concern related to the traffic management/enforcement needed to protect pedestrians and bicyclists along with general security issues around school sites. City staff are working in collaboration with designated school representatives to address the identified areas of concern in relation to traffic enforcement and the development and future implementation of the City of Menifee’s Complete Streets Plan. This Plan is in the early stages of development and focuses on designing and maintaining planned roadways to ensure safe and convenient access for users of all modes of transportation.
Additionally, the Menifee PD SROs are working with the schools to help address the referenced school site security issues.
Next Steps
City staff will work with the Committee and school representatives to schedule the next Education Summit in the fall. In keeping with the request for more frequent issue specific meetings, City staff are continuing to meet with the various school representatives as needed to address public infrastructure projects and safety response and training measures that impact schools in alignment with the City’s new Strategic Plan.

SUBJECT: Discussion on the Creation of a Business Incentive District MEETING DATE: April 5, 2023
TO: Mayor and City Council
PREPARED BY: Gina Gonzalez, Economic Development Director REVIEWED BY: Gina Gonzalez, Economic Development Director APPROVED BY: Armando G. Villa, City Manager

RECOMMENDED ACTION
1. Discuss the creation of a Business Incentive District within the City of Menifee.
DISCUSSION
BACKGROUND
On November 16, 2022, at the request of Mayor Bill Zimmerman, the City Council added a future agenda item to discuss the creation of a Business Incentive District (BID).
BIDs or enterprise zones are used to encourage inclusive economic growth through the expansion, attraction, and retention of small and mid-sized firms typically in a city base-sector economy. The BID concept is used to harmonize public-private companies, while encouraging growth within a certain boundary of a city. In exchange for locating within the selected boundary, the city would use incentives to drive interest. Some examples of incentives could be an alternative to (not a replacement of) existing zoning standards, allowing additional building height and density, standalone residential use for nodes and public benefits, parking, architectural standards, fee reductions, broker incentives, property tax reductions, and/or expedited permit processing.
The BID is an overlay that would span over a select boundary and would involve public right of ways, and potentially private and/or public property. The boundaries are encouraged to implement recommendations identified and adopted in the specific plans of the City. The overlay would address a set of desirables for the district that are uses allowed by-right. For example they could potentially encourage life science, technology, healthcare manufacturing, a certain number of jobs created, jobs with a certain income threshold, etc.
Additionally, it is also important to note that in adherence with the City Council’s Strategic Plan, the City’s Economic Development Department, along with Community Development, Engineering Item Title: 12.4

(Land Development), Building and Safety, and Fire Departments are collectively working on a matrix for the incentives for lifestyle and office development within the City. These two specific types of development are in demand and need incentives due to serious market constraints. Once the matrix is completed, staff will conduct a workshop to discuss the two studies and the overall proposed matrix for office and lifestyle development incentives for consideration by the City Council.
