RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Public Improvement Agreement to guarantee the completion of required public improvements associated with Tract No. 37439 by BRPLD LLC, located east of Briggs Road and south of Holland Road, bordering City of Menifee Limits.
DISCUSSION
Tract No. 37439, also known as Canterwood (“Project”), is a proposed residential development in the unincorporated area of the County of Riverside just outside of Menifee city limits. The Project is located east of Briggs Road and south of Holland Road as shown in the attached location map.
While the Project is not located within the city limits, BRPLD LLC (“Developer”) is required to make sewer improvements that fall within Menifee city limits from Briggs Road to Tres Lagos Drive.
The Developer has requested the approval of a Public Improvement Agreement (“PIA”) as required by the Project’s conditions of approval. The PIA requires that improvement securities are posted to guarantee the completion of the required sewer improvements within 24 months from the City Council approval date of the agreement.
Staff has reviewed the Developer’s request and determined that the proposed PIA meets the requirements of the Project’s conditions. A summary of the bond being posted to guarantee the required improvements is shown in Table 1 on the following page.
