Emergency Shelters, Transitional & Supportive Housing - Amend to facilitate emergency shelters & limit denial of emergency shelters & transitional and supportive housing under the Housing Accountability Act. Transitional & Supportive Housing by- right in all zones allowing residential uses, subject to only regulations that would apply to other residential uses of the same type in the same zone.
Amend Code to comply with AB 2162 which requires supportive housing to be “by right” in zones where multifamily and mixed uses are permitted, including multifamily zones permitting multifamily uses.
Amend Code to comply with Transitional Housing Act of 2019 (AB 139) to meet requirements for addressing homeless and emergency shelter needs, including methodology for determining basis of emergency shelter need & establishment of various parking standards for emergency shelters.
Amend definitions of Supportive Housing, Supportive Services & Target Population consistent with the CA Government Code.

• Amend Code to permit Group Residential Facilities and Residential Day Care (7 or more persons) by right or with a CUP in Rural Residential zones per State & federal law & promote objectivity and approval certainty. • Review and amend “Reasonable Accommodation” provisions to clarify findings for granting a reasonable accommodation to remove constraints to housing for persons with disabilities. Evaluate specific required finding that “the requested accommodation will not, under the specific facts of the case, result in a direct threat to the health or safety of other individuals or substantial physical damage to property of others.

Family
Definition of Family – Update Zoning Code to include a definition of “Household” as it relates to family, update definition of “Family”, “Single Housekeeping Unit”, and “Dwelling, Single Unit” to ensure compliance with all federal and state fair housing laws. The Code shall not distinguish between related and unrelated persons or impose limitations on the number of people that may constitute a family.
