CITY OF MENIFEE
SUBJECT: Notice of Completion and Acceptance for the Holland Road / I-215 Overcrossing Water, Sewer, and Recycled Water Utility Project
MEETING DATE: January 17, 2024
TO: Mayor and City Council
PREPARED BY: Carlos Geronimo, Engineering Manager
REVIEWED BY: Nick Fidler, Public Works Director
APPROVED BY: Rebekah Kramer, Acting City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Accept the improvements for the Holland Road / I-215 Overcrossing Water, Sewer, and Recycled Water Utility Project, Capital Improvement Program (“CIP”) Project No. 13-03; and

2. Authorize the City Clerk to file a Notice of Completion with the Riverside County Recorder’s Office.

DISCUSSION
The Holland Road Water, Sewer, and Recycled Water Utility project (“Utility Project”) was created to support the Holland Road Overcrossing project (“Project”) and consisted of relocating existing water facilities and installing new recycled water and sewer infrastructure that did not exist previously. Due to changes in grade and elevation required to accommodate extension of the Project over the I-215, the Utility Project was necessary to ensure that access to critical utility infrastructure would be available to existing properties and businesses located along the south and west sides of the Project.

On October 19, 2022, the City Council approved a utility construction budget of $815,000 for the Utility Project and authorized the City Manager to approve the construction contract with Ferreira Coastal Construction Company (“Contractor”) in the amount of $719,174 to complete the construction work. Despite the Contractor beginning work immediately following the City’s notice to proceed, initial excavations for underground utilities exposed several unmarked and unknown utilities, as well as other unknown site conditions. These discoveries prevented the timely execution of the work and resulted in the need for several changes to the Contractor’s original scope of work. The final construction costs for the Utility Project totaled $920,908.56, which included seven contract change orders (“CCOs”), as outlined in Table No. 1 below.

The Utility Project is now complete and the final CCO has been submitted. If approved, a Notice of Completion (“NOC”) would be filed, which protects the City from future claims against the Utility Project by providing proper noticing to each contractor, subcontractor, and material supplier, that the Utility Project has been completed. The payment bond would be released upon acceptance by the City and the performance bond would be released one year after the date of recording of the NOC. The City has not received stop notices that would prevent said releases.

Connectivity and Mobility

FISCAL IMPACT
There is no fiscal impact associated with the acceptance of the improvements related to the Utility Project. Funding for all work related to the Utility Project was available through the adopted fiscal year 2023/2024 CIP Budget and previously approved developer appropriations.
