RECOMMENDED ACTION
1. Accept the landscape improvements for Tracts 30142 and 30142-2, Hidden Hills by KB Homes Coastal, located east of Murrieta Road and south of Craig Avenue; and
2. Approve and authorize the City Manager to execute a license agreement with the Hidden Hills Homeowners Association (“HOA”) authorizing the HOA to perform maintenance on designated facilities within public right-of-way.
DISCUSSION
KB Home Coastal is the developer (“Developer”) of Hidden Hills (“Project”), a residential development located east of Murrieta Road and south of Craig Avenue, as shown in the attached project map. Tract Map (“TM”) 30142 consists of 53.67 gross acres of land subdivided into 202 lots for residential use and TM 30142-2 consists of 65.94 gross acres of land subdivided into 195 residential lots. The Developer constructed backbone improvements for streets, drainage, water, and sewer systems that were previously accepted by the City on November 2, 2022.
The Developer has now completed the landscaping improvements on open space lots 198, 199, and 202 of Tract 30142-2, and Lots 204 to 207, 210, 212, and 215 of Tract 30142. The Developer is requesting acceptance of the completed landscape improvements into the City’s maintenance system. Staff have inspected the completed landscape improvements, determined that the improvements have been constructed in accordance with City specifications and standards, and verified that all project conditions of approval have been met.
The Project’s conditions of approval require that the Developer annex certain public facilities and open spaces into the City’s community facilities district (CFD) for maintenance purposes. CFD

2012-2 was previously established for the Project with specific areas of maintenance responsibility designated for the City and other areas designated to be maintained by the HOA.
There are facilities designated as HOA-maintained that fall within public right-of-way that are located within TM30142 and TM30142-2 entrances on Yeoman Place, Quilt Way, and Beth Avenue.
The attached license agreement (“Agreement”) is proposed to permit the HOA to maintain specific landscape areas located in public right-of-way. HOA responsibility would include payment of electric and water services associated with these areas. If approved, the proposed Agreement would take effect immediately.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. The Developer has paid all necessary fees and deposits to cover the costs of the required inspection of the completed public landscape improvements. Ongoing costs for the City maintained improvements will be supported through approved Fiscal Years 2023/2024 and 2024/2025 operating budgets in CFD 2012-2.
