A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA,
APPROVING THE QUITCLAIM DEED WITH CERTIFICATE OF ACCEPTANCE FOR
BANNER VILLAGE PARK
WHEREAS, the City of Menifee was incorporated on October 1, 2008, and pursuant to the Terms and Conditions of incorporation, upon incorporation assumed authority over parks in the City’s boundaries pursuant to Resolution No. 08-24 as of that date; and WHEREAS, Banner Village Park was built on Tract 32102-1, recorded as Book 475 of Maps, pages 10 through 21, inclusive, and dedicated to the City of Menifee as a condition of approval of the final tract map; and
WHEREAS, the form of the Quitclaim Deed and Certificate of Acceptance granting Banner Village Park, described as Lot 136 of recorded Tract Map 32102-1, from Pulte Home Company, LLC, to the City, attached hereto as Exhibit “A”, has been reviewed by City Staff; and WHEREAS, in order to satisfy the original condition of approval and complete the transfer of Banner Village Park from Pulte Home Company, LLC, to the City, the City Council now desires to approve and record the said Quitclaim Deed with Certificate of Acceptance through adoption of this Resolution.
NOW, THEREFORE, the City Council of the City of Menifee, California, hereby resolves and orders as follows:
Section 1. Approval of Quitclaim Deed with Certificate of Acceptance. The City of Menifee hereby accepts and approves the Quitclaim Deed with Certificate of Acceptance for Banner Village Park, which is located on Lot 136 of Tract 32102-1 as filed in Book 475 of Maps, pages 10 through 21 inclusive.
Section 2. Authorization to Execute Certificate of Acceptance. The City of Menifee hereby authorizes the Public Works Director to execute the Certification of Acceptance as included on the form of the Quitclaim Deed with Certificate of Acceptance, attached hereto as Exhibit “A”.
