WHEREAS, the hereinafter-described portion of Cumming Avenue was 9 dedicated for public road and utility purposes on the Tract Map of Romola No. 5, 10 recorded in Map Book 14, Pages 44 through 46, inclusive, Official Records of the 11 12 Recorder of Riverside County, California; and,
13 WHEREAS, the offer of dedication for said portion of Cumming Avenue has not 14 15 been accepted for public use by the County of Riverside; and, 16 WHEREAS, the hereinafter-described portion of Cumming Avenue is not 17 18 necessary and is excess Right of Way, and not required for public street and highway 19 purposes, now, therefore;
20 BE IT RESOLVED, DETERMINED AND ORDERED by the Board of 21 22 Supervisors of the County of Riverside, State of California, in regular session assembled on June 20 , 2006, as follows:

2 Pursuant to Section 8334(a) of the Streets and Highways Code that 3 the hereinafter-described portion of Cumming Avenue is excess Right 4 of Way and is no longer required for public street and highway 5 purposes and is hereby summarily vacated.

8 AS EXHIBITS "A" AND "B" AND MADE A PART HEREOF

EXCEPTING AND RESERVING from the vacation an easement for any existing public utilities and public service facilities, together with the right to maintain, operate, 12 replace, remove, or renew such facilities, pursuant to section 8340 of the Streets and 13 14 Highways Code.
2. That the herein-described portion of Cumming Avenue is unnecessary for 15 present or prospective public use, including use as a non-motorized 16 transportation facility.
