A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MENIFEE, CALIFORNIA, APPOINTING BEN DIEDERICH TO THE OFFICE OF DISTRICT 2 COUNCILMEMBER PURSUANT TO GOVERNMENT CODE SECTION 34902, WHICH APPOINTMENT
SHALL BE EFFECTIVE IMMEDIATELY AND SHALL CONTINUE THROUGH THE CERTIFICATION OF THE NOVEMBER 2026 REGULAR MUNICIPAL ELECTION WHEREAS, in December 2022, Ricky Estrada was sworn in as the elected District 2 Councilmember of the City of Menifee, with a term scheduled to conclude with the certification of the November 2026 regular municipal election; and
WHEREAS, in December 2024, Ricky Estrada, was elected to the Office of the Mayor in the regular municipal election, creating a vacancy for District 2 on the City Council; and WHEREAS, Government Code section 34902, though written for the Office of the Mayor, applies to all vacancies, states "In the case of a vacancy in the office of the mayor for any reason, the council shall fill the vacancy by appointment. ... A person appointed or elected to fill a vacancy shall hold office for the unexpired term of the former incumbent”; and
WHEREAS, the City Council has resolved to discharge its obligation under Government Code section 34902 by appointing Ben Diederich to serve as District 2 Councilmember of the City of Menifee through the expiration of Ricky Estrada’s term in December 2026; and WHEREAS, Ben Diederich has expressed a willingness and desire to assume the District 2 Councilmember seat.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Menifee, California hereby to determine and order as follows:
Section 1.As authorized by Government Code section 34902, the City Council of the City of Menifee hereby selects Ben Diederich to fill the District 2 City Council vacancy.
Section 2.Ben Diederich has indicated his willingness and desire to assume the District 2 City Council seat commencing immediately and continuing through December 2026.
Section 3.The City Clerk is directed to administer the oath of office to Ben Diederich.
Section 4.Ben Diederich shall serve as District 2 Councilmember of the City of Menifee until the successful candidate for District 2 in the November 2026 election assumes office.
