RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute Amendment No. 1 to the Letter of Engagement with Colantuono, Highsmith and Whatley, PC for legal services, increasing the amount by $77,000 for a total not-to-exceed amount of $100,000.
DISCUSSION
Per the City’s Municipal Code Section 3.12.040, on December 17, 2024 the City signed a Letter of Engagement with Colantuono, Highsmith and Whatley, PC under the City Manager’s signing authority for a not-to-exceed amount of $23,000. Colantuono, Highsmith and Whatley, PC have provided third-party legal services to the City relating to the Richland Communities project in the City of Perris.
Due to on-going litigation, an amendment of $77,000 for a total not-to-exceed contract amount of $100,000 is being requested. All other terms of the agreement shall remain the same. Pursuant to the City’s Municipal Code Section 3.12.090, any change orders in the contract amount that exceed $25,000 in value shall be approved by City Council.
