CITY OF MENIFEE
SUBJECT: Agreement with Meritage Homes of California Inc., for Modifications to the Traffic Signal at Menifee Road and McCall Boulevard
MEETING DATE: April 2, 2025
TO: Mayor and City Council
PREPARED BY: Chet Robinson, Principal Engineer
REVIEWED BY: Nick Fidler, Public Works Director
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Approve and authorize the City Manager to execute an In Lieu Fee Agreement with Meritage Homes of California, Inc., for developer fee payment in the amount of $15,840 in lieu of constructing modifications to the existing traffic signal located at Menifee Road and McCall Boulevard.

DISCUSSION
Meritage Homes of California, Inc., a California Corporation (Meritage), is the developer of Stone Creek Tract Map 36365; a residential housing tract consisting of 224 lots located at the southeast intersection of Grand Avenue and Leon Road in the County of Riverside. As part of the development’s requirements, Meritage was conditioned to modify an existing traffic signal to add a southbound right-turn overlap at the intersection of Menifee Road and McCall Boulevard within the City of Menifee.

Future modifications are also planned at the traffic signal as conditioned for the McCall Square project (Parcel Map 37624)(“Project”). The McCall Square project work would include a more comprehensive modification to the traffic signal. As such, the City has requested that Meritage pay an in-lieu fee for their conditioned improvement, rather than construct it ahead of the McCall Square project modification. The in-lieu payment amount would then be available to support the required modifications at the time of the McCall Square project traffic signal work.

Meritage has agreed to provide the City with a payment in the amount of $15,840 in lieu of modifying the traffic signal. The proposed In Lieu Fee Agreement (“Agreement”) memorializes the in lieu payment between Meritage and the City. If approved, Meritage would provide immediate payment to the City in the full amount of the in-lieu fee.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. All costs for development and review of the Agreement have been borne by the developer. The payment received by the City would in turn be used by another developer to provide the traffic signal modifications.
