RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute Amendment No. 1 to the Professional Services Agreement with Parsons for the Menifee Road Widening – Garbani Road to Scott Road Project, Capital Improvement Program (CIP) Project No. CIP 23-12, increasing the compensation amount by $309,065, for a total not-to-exceed amount of $1,283,375.
DISCUSSION
The Menifee Road Widening Project, Capital Improvement Program (CIP) No. 23-12 proposes widening the segment of Menifee Road between Garbani Road and Scott Road from an existing two-lane road to a four-lane corridor. The Project would also relocate existing overhead utilities, modify existing storm drain culverts impacted by the widening of the road, and install sidewalk and pedestrian ramps.
On July 19, 2023, the City Council approved a Professional Services Agreement (PSA) with Parsons (“Consultant”) to provide architectural and civil design services and plans, specifications, and estimates (PS&E) for the Project.
While staff makes every effort to anticipate all work-related items based on available existing information to produce a comprehensive scope of work encompassing all tasks required for the preparation of construction documents, it is only through the actual design process that project issues are discovered, and all impacts identified. During the environmental and design process, it became evident that the project would have more impacts to adjacent properties, unknown during the preliminary engineering phase. The expanded scope of work included in Amendment No. 1 would require additional Consultant efforts and result in an increase of $309,065 to the PSA, bringing the total not-to-exceed amount to $1,283,375, as summarized in Table 1 on the following page.

Original Agreement July 19, 2023 Environmental and civil design services $974,310
Amendment No. 1 Pending Additional ROW support and
environmental analysis $309,065
TOTAL $1,283,375
A more detailed summary of the expanded scope of work included in Amendment No. 1 includes the following:
•Additional right-of-way (ROW) engineering/acquisition support: The Project originally anticipated acquisition of six parcels. However, the current design and ROW impacts include the need to add Drainage Easements and Temporary Construction Easements due to grading outside of the existing right-of-way that would now impact a total of 21 parcels. The need for these easements was unknown during planning development due to the absence of topographical survey and drainage studies that only become available during the design process.
•Additional environmental analysis: Revisions to the environmental document are required for the preparation of a Community Impact Assessment Memorandum to address the replacement of existing unauthorized residential driveways encroaching on the City’s ROW which were previously constructed in restricted zones along Menifee Road.
Pursuant to the Menifee Municipal Code §3.12.090, amendments or change orders in the amount greater than 10% of the Agreement amount or that exceed the City Manager’s signing authority shall be approved by the City Council.
