RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute Amendment No. 5 to the Professional Services Agreement with KOA Corporation for the McCall Boulevard Widening Project, Capital Improvement Program (CIP) Project No. 22-03, located between Oakhurst Avenue and Junipero Road, for right-of-way engineering services, increasing the compensation amount by $7,560, for a total not-to-exceed amount of $304,903.38.
DISCUSSION
The McCall Boulevard Widening Project, CIP Project No. 22-03 (Project), is located between Oakhurst Avenue and Junipero Road. The existing roadway is two lanes for approximately a half mile before expanding to a four-lane roadway. There is a need for additional vehicle lanes to support current and future traffic volumes due to the increased residential and commercial development in the area. Under the City’s General Plan, this segment of McCall Boulevard is designated as an arterial roadway that would ultimately provide six vehicle lanes. The Project would widen the existing two-lane road to a four-lane corridor and establish horizontal and vertical alignments to meet the requirements of the California Highway Design Manual and City standards. The Project is currently in the final phase of design.
On June 21, 2023, the City Council approved a Professional Services Agreement (Agreement) with KOA Corporation (Consultant) to provide civil design, plans, specifications, and estimate (PS&E) services for the Project. Included in the Consultant’s scope of work is right-of-way (ROW) engineering services. It was initially anticipated that ROW efforts would include temporary construction easements (TCE) and/or permanent maintenance easements (PME) for the two private properties impacted by the Project.

The first property, identified as Assessor’s Parcel Number (APN) No. 333-070-041, requires only a TCE. The second property, identified as APN No. 333-080-028, was expected to require both a TCE and a PME. It is standard practice to offer fifty percent of the appraised property value for a TCE or PME. During negotiations, the property owner of APN No. 333-080-028 was not amenable to a TCE or PME and instead requested that the City purchase the portion of the property that would be impacted by the Project at one hundred percent of the appraised value. The City has determined that purchasing in fee would be acceptable for the second property, identified as APN No. 333-080-028. Negotiations with both property owners are ongoing. The proposed Amendment No. 5 would allow the Consultant to complete the additional ROW efforts required to finalize negotiations with both property owners, allowing the Project to move forward to the final design phase. Amendment No. 5 would increase the Consultant’s compensation by $7,560, increasing the total not-to-exceed amount of the Agreement to $304,903.38. The Consultant’s amendment history for the Project is summarized in Table 1 below.
