RECOMMENDED ACTION

1. Introduce an ordinance amending Menifee Municipal Code Title 12, Section 12.20.140 to prohibit certain commercial vehicle parking on City streets and highways.

DISCUSSION
Title 12, Section 12.20.140 of the Menifee Municipal Code (MMC) addresses the parking of large commercial vehicles, commercial trailers, and semi-trailers in the City of Menifee. The current MMC generally prohibits the parking of a commercial vehicle having a manufacturer’s gross vehicle weight rating of more than 10,000 pounds, or any commercial trailer or semi-trailer regardless of weight, on any street or highway within a residential district or on any undeveloped private property.

The Public Works and Menifee Police Departments have received multiple complaints from residents and business owners regarding commercial vehicles parked on streets throughout the City outside of residential districts, including, without limitation, in commercial areas and areas adjacent to hospitals. Commercial vehicles parked on City streets contribute to traffic congestion, obstruct motorist sight distance and signage, and impair residents’ access to local businesses and services.

Accordingly, and pursuant to authority granted to the City under the California Vehicle Code, staff recommends that the City Council consider the adoption of the attached ordinance: An Ordinance of the City Council of the City of Menifee amending MMC Title 12, Section 12.20.140 to prohibit certain commercial vehicle parking on City streets and highways (Ordinance).

The Ordinance, if adopted, would:
Establish heavy commercial vehicles to be those having a manufacturer’s gross vehicle weight rating of more than 10,000 pounds and more than two axels, or any commercial trailer or semi-trailer regardless of weight.
Expand prohibition on the parking of heavy commercial vehicles to apply within all City streets, highways, and rights-of-way, instead of only in residential districts or undeveloped private property.
Prohibit parking on any designated non-privately owned open space within the City.

Exceptions would continue to apply for vehicle loading and unloading, the performance of service on a property, school, and passenger buses, public entity maintenance and related vehicles, and emergency vehicles.

Vehicle Code Section 22507 requires local agencies adopting restrictions on the stopping, parking, or standing of vehicles to place signs or markings giving adequate notice of the restrictions. If adopted, the Ordinance would take effect January 1, 2026, and require the City Manager or designee to post signs providing notice of the parking restrictions at major entry points into the City.
