RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Right-of-Way Contract, and all other necessary related documents thereof, with PHH Real Estate, LLC, for a portion of real property identified as Assessor Parcel Number 333-080-028, for the McCall Boulevard Widening – Oakhurst Avenue to Junipero Road Project, Capital Improvement Program (CIP) Project No. 22-03, for a total amount not-to-exceed $69,762.
DISCUSSION
The McCall Boulevard Widening – Oakhurst Avenue to Junipero Road Project (CIP No. 22-03) (Project) is located between Oakhurst Avenue, near the entrance to Menifee Global Medical Center, and Junipero Road. The existing roadway currently consists of two lanes for approximately one-half mile before expanding to four lanes. Due to ongoing residential and commercial development in the area, additional travel lanes are needed to accommodate existing and projected traffic volumes. Under the City’s General Plan, this segment of McCall Boulevard is designated as an arterial roadway planned for an ultimate width of six total lanes. The Project would widen the existing two-lane segment to four lanes to bring the full Project segment to an interim four-lane corridor and establish new horizontal and vertical alignments consistent with the California Highway Design Manual and City standards. The Project is currently in the final phase of design.
On June 21, 2023, the City Council approved a Professional Services Agreement with KOA Corporation (Consultant) to provide civil design, plans, specifications, and estimate (PS&E) services for the Project. The Consultant’s scope also includes right-of-way (ROW) engineering and acquisition services. As part of this process, the City must occasionally acquire and compensate property owners for Temporary Construction Easements (TCEs) and partial fee

interests to obtain the legal rights necessary to access or modify private property for public infrastructure improvements.
During a closed session meeting on August 21, 2024, the City Council authorized staff to begin negotiations for the acquisition of a Permanent Maintenance Easement (PME) and a TCE for the property identified as Assessor’s Parcel Number (APN) 333-080-028, owned by PHH Real Estate, LLC (Owner). The Owner declined the easement proposal and requested that the City purchase the impacted portion of the property in fee at 100 percent of its appraised value. The City determined that a fee acquisition was acceptable for this property.
On September 17, 2025, staff returned to closed session and received City Council authorization to proceed with an offer to purchase the property in fee. The appraisal report prepared by the Consultant established the fair market value and just compensation at an amount not to exceed $69,762, which includes both the TCE and the partial fee acquisition. These ROW acquisitions are necessary to advance the Project into the construction phase by providing temporary access and permanent rights to portions of the affected property.
The Project requires both a Grant of TCE and a ROW Contract for a Partial Fee Interest to complete the proposed improvements. The TCE would provide temporary access to 997 square feet of property located northeast of the McCall Boulevard and Woodside Way intersection, with an estimated value of $1,704. The Partial Fee Interest includes 7,164 square feet of property located northwest of the same intersection, with an estimated value of $68,058. The total combined estimated cost for both the TCE and Partial Fee Interest acquisitions is $69,762.
Pursuant to Menifee Municipal Code §3.12.200, all acquisitions of real property, including temporary agreements for the use of real property for a period of more than one day, must be approved by the City Council.
