3. Adopt a budget amendment resolution appropriating $444,358 in expenditures within the Capital Projects Fund 4320 to the Project account to support the Project’s current and anticipated Right-of-Way acquisition needs.

DISCUSSION
Valley Boulevard is currently a two-lane rural corridor between Chambers Avenue to its southern terminus near Murrieta Road. With continued residential and commercial growth in the City's northwestern area, additional roadway capacity is now needed to accommodate increased traffic volumes. Under the City’s General Plan, this segment of Valley Boulevard is designated as an arterial highway that will ultimately provide four lanes of travel. The Valley Boulevard Widening and Missing Links Project, CIP 22-02 (Project) proposes widening the existing roadway from two to four lanes and establishing new horizontal and vertical alignments in accordance with the California Highway Design Manual and City standards. The Project is currently in the final phase of design.

On January 19, 2022, the City Council approved a Professional Services Agreement with Dokken Engineering (Consultant) to provide civil design, plans, specifications, and estimate (PS&E) services for the Project. The Consultant’s scope also includes right-of-way (ROW) engineering and acquisition services. proper
The Project would address two key missing roadway links along Valley Boulevard. The first gap is located north of the intersection of Valley Boulevard and McCall Boulevard. To complete this connection, staff proposes to acquire approximately 92,051 square feet of vacant land, identified as Assessor Parcel Number (APN) 335-080-013 (Property), from McCall Senior 37, LLC through a ROW Contract. This acquisition is necessary to establish roadway connectivity between Chambers Avenue and McCall Boulevard. Under the Developer Agreement (DA) with Pulte Homes (Developer), the City must secure the necessary ROW by December 2025 to allow the Developer to complete their conditioned frontage improvements. During a closed session meeting on August 20, 2025, the City Council authorized staff to proceed with an offer to purchase the Property for an amount not to exceed $226,600. This amount includes the Property purchase price, escrow fees, and closing costs, which would be finalized upon close of escrow. An appraisal report prepared by the Consultant determined the fair market value and just compensation for the Property to be $206,000.

Additional Property Acquisitions
The second missing link is located north of the Salt Creek Trail, within the Eastern Municipal Water District (EMWD) Perris II Desalination Plant and Regional Water Reclamation facilities west of Murrieta Road. The City and EMWD are currently coordinating to finalize the ingress and egress layout for EMWD’s facilities and determine the City’s ROW needs. Additional property acquisitions are anticipated for several residential parcels located along the east side of Valley Boulevard.

These acquisitions will involve Temporary Construction Easements (TCEs) to allow for the installation of adequate retaining walls. The estimated costs of the TCEs would range from $1,000 to $5,000 per property, depending on the extent of property required. Staff is actively working with the Consultant to identify all property needs and would return to the City Council at a future date to request authorization to proceed with offers for the remaining ROW acquisitions necessary to move the Project forward to the construction phase.

Funding Source
Several Community Facility Districts (CFDs) within the City have issued bonds to finance the construction of public infrastructure improvements that serve and enhance the respective CFD areas. As part of the City’s ongoing efforts to strategically utilize available funding sources, staff have reviewed bond premiums and identified $444,358 in eligible funding within CFD 2023-2 (Cimmaron Ridge). Staff propose allocating these funds to support the current and anticipated ROW acquisition needs associated with the Project, including the missing links and any TCEs for impacted residential properties. Utilizing CFD bond proceeds for this purpose is consistent with the eligible use of funds, as the acquisition of ROW directly facilitates public improvements that would enhance roadway connectivity, improve traffic circulation, and support planned development within and adjacent to the Cimmaron Ridge development. This targeted allocation would ensure that available CFD resources are effectively leveraged to advance the City’s infrastructure goals.
