RECOMMENDED ACTION
1. Adopt an ordinance approving Amendment No. 1 to the Development Agreement with BLC Fleming, LLC and Lennar Homes of California, LLC for the Legado Specific Plan, located south of Rouse Road, west of Antelope Road, north of Chambers Avenue and east of Encanto Drive.
DISCUSSION
At the November 5, 2025, City Council meeting, the City Council introduced an ordinance to approve Amendment No. 1 to the Development Agreement (DA) No. 2018-277 for the Legado Specific Plan. This is the required second reading and adoption. If adopted, the ordinance would become effective 30 days from the date of adoption.

The proposed adjustments included within the proposed DA Amendment No. 1 represent a reduction in Development Impact Fee (DIF) revenue collection in the amount $44,064 with the extension of the DIF freeze. Additional indirect fiscal impacts to the City include the timing of when elements of the parks and paseos are turned over to the City. These items will change the timing and nature of expenditures for Community Facilities District (CFD) maintenance and will have offsetting effects. Lennar will realize cost savings of $469,844 from the reduction of the required contingency from 15% to 5% to assist in meeting the amenities desires by the community. These cost savings help offset the existing funding gap for the TR37408 and TR37409 paseo and park improvements.
