RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute Amendment No. 3 to the Professional Services Agreement with Rick Engineering Company to prepare the Menifee Innovation District Specific Plan, extending the terms of services through June 30, 2027.
DISCUSSION
The Planning Division of the Community Development Department currently utilizes Rick Engineering Company to provide the planning services needed to prepare the Menifee Innovation District Specific Plan (previously known as the Southern Gateway Specific Plan) as well as the required Environmental Impact report (EIR) in compliance with the California Environmental Quality Act (CEQA). On December 6, 2023, the City entered into a Professional Service Agreement (PSA) with Rick Engineering Company for a not-to-exceed amount of $637,096.
Per the City’s Professional Services Policy, on November 18, 2024 the City administratively approved Amendment No. 1 under the City Manager’s signing authority to amend the fund amount by $3,900 for a not-to-exceed amount of $640,996 for the creation of the Ad Hoc Committee as directed by City Council. Under the same policy, Amendment No. 2 was administratively approved on August 4, 2025, amending the fund amount by $57,715 for a not-to-exceed amount of $698,711 to allow for additional community design meetings and workshops. Due to unforeseen delays in the project and the anticipated time needed to complete the Specific Plan document as well as the EIR, staff is requesting an extension of the terms of services through June 30, 2027.
All other terms of the agreement shall remain the same. Pursuant to Resolution No. 24-1569 and Menifee Municipal Code §3.12.150, amendments or change orders in the aggregate amount greater than 10% of the agreement amount, exceeds a time extension of 120 days, or that exceeds the City Manager’s signing authority shall be approved by the City Council.

FISCAL IMPACT
All funds for the PSA with Rick Engineering Company have been approved for the Fiscal Year 2025/2026 operating budget for the Planning Division. No additional budget appropriation action is required for the recommended action.
