RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Landscape Maintenance Agreement with the California Department of Transportation (Caltrans) for maintenance of public improvements for Parcel Map 37992, located north of California State Route 74 and west of Palomar Road.
DISCUSSION
Parcel Map 37992 (PM37992), also known as the Motte Country Plaza (Project), is a proposed subdivision of 3.80 gross acres of land to be subdivided into two lots for commercial use. As part of the Project’s conditions of approval, Palomarmar LP and Motte Country Plaza, LLC (Developers) are required to construct public improvements, including landscape, within the public right-of-way along California State Route 74 (SR 74). The Project is located on the north side of SR 74 and west of Palomar Road.
The Project is also conditioned to be annexed into the City’s Community Facilities District (CFD) for public improvement maintenance. Being that the improvements will be constructed in Caltrans’ right-of-way, and in order for the City to perform maintenance of these landscape improvements through the CFD, the City must enter into a Landscape Maintenance Agreement (Agreement) with Caltrans. The proposed Agreement would provide the City with the authorization necessary to carry out landscape maintenance activities along the SR 74 frontage of the Project’s property and would also establish each agency’s roles and responsibilities related to the maintained areas.
The proposed Agreement has been reviewed by the City Attorney’s Office.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. Costs associated with landscape maintenance would be supported by the annexation of this parcel into maintenance CFD 2017-1.
