RECOMMENDED ACTION
1. Adopt two budget amendment resolutions authorizing the Menifee Police Department to appropriate asset forfeiture funds in the amount of $55,170 for the purchase of a replacement Dodge Durango and required upfitting.
DISCUSSION
In August of 2020 the County of Riverside transferred $88,653.07 to the City of Menifee in asset forfeiture funds. These funds were previously overseen by the Riverside County Sheriff’s Department. Through joint task force cases the Menifee Police Department (MPD) has also received an additional $186,245.88 since 2021. These funds are the MPD’s portion of multiple state cases resulting in asset forfeiture funds being allocated through the Department of Justice (DOJ) Equitable Sharing Guidelines. These funds have been deposited into the City’s State Asset Forfeiture Fund (8350-231500) until needed for eligible uses. The MPD has requested previous appropriations of the asset forfeiture funds as shown below in Table 1 below.

The requested appropriation would be allocated to a capital outlay account in the amount of $55,170 to fund the full purchase of a replacement Dodge Durango with associated upfitting. The goal of this new unit is to replace the current K9 Dodge Durango that has a blown motor and is not fiscally feasible to be repaired. Because multiple components from the existing Durango can be reused in the new unit and it is classified as off-the-lot rather than patrol rated, the overall vehicle and upfitting costs are reduced.
The purchase and corresponding upfitting for the new vehicle would be facilitated through West Coast Lights and Sirens, and Moreno Valley Dodge. Pending the recommended appropriation of $55,170, the remaining balance in the restricted Trust Fund would be $112,364.95.
The purchase of the Dodge Durango and associated upfitting would be made under the City Manager’s purchasing authority pursuant to Resolution No. 24-1569.
STRATEGIC PLAN OBJECTIVE
Safe and Vibrant Community
FISCAL IMPACT
Funding for the purchase and upfitting of the vehicle is available within the City’s Trust Fund which holds a current balance of $167,534.95 received from various asset forfeitures over the last several years. Accordingly, $55,170 from the full amount held in trust will be recognized as revenue in the Trust Fund (8350-434680). The funding would then be transferred out of the Trust Fund (8350- MPD-901100) and transferred into the General Fund (1100-808350). The corresponding expenditures would be appropriated within the General Fund to acquire the vehicle and the required upfitting as an asset to the City (1100-MPD-660000), as summarized in Table 2 below.

Future fiscal impacts include the cost for maintenance and fuel for the vehicle. Those costs would be budgeted accordingly in future fiscal years in the fleet accounts.
