RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute an Improvement Agreement to guarantee the completion of required improvements associated with Bailey Park Conditional Use Permit (CUP) 2019-013, by CG Menifee 1, LLC and CG Menifee 2, LLC, located south of Scott Road, west of Bailey Park Boulevard, and east of Zeiders Road.
DISCUSSION
Bailey Park CUP 2019-013 (Project) for Parcel Map 16197 Lots 3 and 4 is a commercial retail project by CG Menifee 1, LLC and CG Menifee 2, LLC (Developers). The Project is located south of Scott Road, west of Bailey Park Boulevard, and east of Zeiders Road. The Project proposes a two-story, 21,552 square-foot building that will include 2,848 square feet of office space, 15,220 square feet of sales floor area, and 3,484 square feet of mezzanine storage space on the second floor, and 30 parking spaces on 4.27 gross acres. On January 11, 2023, the Planning Commission approved the Project, known as CUP No. 2019-013.
The Developer is now requesting approval of the Agreement for the Construction of Street and Drainage Improvements (Agreement), as required by the Project’s conditions of approval. The Agreement requires that the improvement bonds be posted to guarantee the completion of the required improvements within 24 months from the date of City Council approval.
Staff have reviewed the Developers’ request and determined that the associated Agreement meets the requirements of the Project’s conditions of approval. A summary of the bonds being posted to guarantee the required improvements are shown in Table 1 on the following page.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. The Developer has paid all necessary fees associated with review of the Agreement and bonds. Upon completion of the improvements, and subsequent acceptance by the City, ongoing maintenance costs for the improvements would be supported through future fiscal year budgets in maintenance Community Facilities District 2017-1, Annexation 33, Zone 33.
