RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute Amendment No. 2 to the Master Agreement with Harris and Associates, Inc., for Civil Engineering and Plan Check Services, increasing the compensation by $100,000, for a three-year total agreement amount not-to- exceed $325,000 through June 30, 2026.
DISCUSSION
On August 17, 2022, the City Council approved a shortlist of qualified firms to provide various categories of on-call professional services to Engineering. Harris and Associates Inc. (Harris) is one of the shortlisted firms designated to provide civil engineering and plan review services for Engineering.
A master agreement was initially established with Harris for a three-year contract term from July 1, 2023, through June 30, 2026, for a total agreement not-to-exceed amount of $150,000. One prior agreement amendment has been approved by City Council to support the continuing demand for civil plan check services and to maintain consultant continuity on development projects already supported by Harris’ services. Harris is currently assisting staff in supporting review for Menifee Valley Specific plan, as well as several commercial and residential developments. Harris has consistently been responsive, providing additional civil engineering assistance to maintain workflow and supporting the timely progress of entitled projects through the review process.
The proposed Amendment No. 2 would increase the Agreement by $100,000, to a total contract not-to-exceed amount of $325,000. The contract not-to-exceed amount represents compensation authorized for services provided for the full three-year term, which began July 1, 2023, and is set

to expire June 30, 2026. All other terms would remain unchanged, as outlined in Table No. 1 below.

Pursuant to Menifee Municipal Code §3.12.060, and Resolution 25-1569, aggregate amendments or change orders in the amount greater than 10% of the contract amount, and any time extension of a performance deadline that exceeds 120 days, shall be approved by the City Council.

FISCAL IMPACT
The fiscal impact of the proposed amendment is not-to-exceed $100,000 through the contract term of Fiscal Year (FY) 2025/2026, bringing the total agreement to a not-to-exceed amount of $325,000. Funding for the proposed amendment is available within the FY 2025/2026 budget, under professional services reimbursable for Public Works Land Development Engineering within the General Fund (1100-PWD-ENGR-652825).
It is important to note that civil engineering and plan check services are fully recoverable as they would be offset by developer fees and deposits collected for the services. City Council previously authorized the Finance Department to issue purchase orders against the Agreement. Purchase orders for these services would only be issued after confirmation of budget availability and only for amounts within the approved not-to-exceed Agreement compensation amounts. No additional budget appropriation actions would be required for approval of the proposed Amendment.
