RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Memorandum of Understanding (MOU) with the Crane Division, Naval Surface Warfare Center for participation in the Electro-Optics Loan Program for night vision equipment in an amount not-to-exceed $1,800; and
2. Authorize the City Manager to execute any subsequent MOU amendments at the City’s discretion and within the available budget; and
3. Approve and authorize the Finance Department to issue a purchase order for the lease of six AN/PVS-15C Night Vision Binoculars from the MOU with the Crane Division, Naval Surface Warfare Center in a not-to-exceed amount of $1,800.
DISCUSSION
The MOU is requested to gain participation in the Law Enforcement Electro-Optics Loan Program (Program). This Program was established in August of 1999 to assist federal, state and local law enforcement agencies in obtaining night vision equipment to accommodate yearly budget costs.
The Loan Program offers nine different models of night vision equipment as outlined in the attached brochure. Menifee Police Department (MPD) SWAT team members researched these models and determined that six units of the AN/PVS-15C Night Vision Binoculars would best meet the MPD needs. The loan cost is $300 per unit, per year. This cost covers repairs, maintenance and or replacement as needed during the loan term. The approximate value for each proposed pair of night vision binoculars is $12,000 per unit. The option for annual renewal is available and would remain in place as long as Crane Division, Naval Surface Warfare Center (Navsea) has availability. There is no obligation for MPD to continue the loan after the initial year term. Upon

completion of the initial year staff would evaluate the program and product quantity and proceed accordingly.
The proposed acquisition of the night vision binoculars would align with the approved equipment needs of the Southwest Cities S.W.A.T. team and fully comply with all regulatory and statutory requirements governing the procurement and use of specialized equipment by law enforcement agencies, including:
1. California Assembly Bill 418 (AB 418):
The department will ensure adherence to all transparency, reporting, and public-access requirements, including documentation of intended use, capabilities, and potential impacts on civil liberties and community trust.
2. Department Policy 706:
All provisions regulating the acquisition, deployment, supervision, and documentation of specialized equipment will be followed. This includes training requirements for authorized users and internal auditing procedures.
3. Government Code §7072:
The department will meet all Military Equipment Use Policy obligations, including necessary public engagement, procurement approval, and annual reporting.
The proposed MOU would remain in force until a renewal is drafted by Navsea or is terminated by mutual agreement of the parties. The night vision optics would be returned to the Navy upon termination of the MOU.
