RECOMMENDED ACTION

1. Award bid and authorize the City Manager to execute a Contract Services Agreement with Co Brothers, LLC to perform construction services for the Audie Murphy Ranch Sports Park Improvements Project, Capital Improvement Project No. 22-27, in a total amount not-to- exceed $499,800; and

2. Adopt two budget amendment resolutions authorizing the appropriation of a transfer out in the amount of $65,000 from available fund balance in Fund 2490 CFD Audie Murphy Ranch and into expenditures within the Capital Projects Fund 4320 to the Project account.

DISCUSSION
The Audie Murphy Ranch (AMR) Sports Park continues to serve as a highly utilized community amenity. As resident use increases in parallel with population growth, upgrades to the facility are necessary to support on-site staffing, enhance public safety presence, and add park amenities that will facilitate the expansion of programs and events. Capital Improvement Program (CIP) Project No. 22-27, AMR Sports Park Improvement (Project), was approved to provide for the construction of two City facilities: a Park Ranger Station and a permanent ticket booth.

Image 1 on the following page shows a rendering of the proposed 902 square feet Park Ranger Station. The proposed facility would include a permanent office for the City’s two full-time Park Rangers, two restrooms, a storage room, and a multi-use room to be used for adaptive displays and programming.

On June 7, 2023, as part of the Project, the City Council approved the design and purchase of the two pre-engineered buildings and material from Romtec, Inc. On October 18, 2023, the City Manager approved an agreement with TKE Engineering, Inc. (TKE) to begin working on the plans, specifications, and construction documents for the utility portion of the project. After extensive collaboration between Romtec, TKE, and City Staff, the project moved to the construction stage.

After a full review of the documents, staff found that the lowest apparent bidder, LGC Construction, did not submit the required bid documents, disqualifying them from the bid process.

Staff then proceeded to complete a thorough review of the second lowest bidder, Co Brothers, LLC and determined that they met the requirements for recommendation as the lowest responsive and reasonable bidder.

The cost of the construction contract is $499,800. Labor compliance, material testing services, contingency, and furniture estimates are currently being procured and are expected to increase the project construction costs to an anticipated total construction cost of $572,482. Construction management and inspections will be provided by City staff.

If approved by the City Council, the tentative Project schedule would be as follows:

Construction Start: April 2026
Construction End: October 2026
City Council Acceptance: December 2026
The timeline above assumes no delays due to weather or unforeseen conditions.

FISCAL IMPACT
The agreement with Co Brothers, LLC, is proposed at an amount not-to-exceed $499,800. The total anticipated cost for the project including construction, labor compliance, facility furniture, contingency, and other costs typically associated with a construction project is estimated at $597,482. Given that the existing approved available budget is $532,482, additional funding in the amount of $65,000 would be required to fully support the project as seen in Table 2 below.

Staff is requesting the additional allocation of $65,000 to account from available fund balance in Fund 2490 CFD AMR to bring the total available project funding to $597,482. If approved, the corresponding expenditure/transfer of $65,000 would be appropriated to the Project budget through a budget amendment resolution (BAR) within the CFD AMR Fund (2490-904320) in the amount of $65,000 and an additional BAR for expenditures within the Capital Projects Fund (4320-PWD-CIPC-906-02490-690050), as summarized in Table 3 on the following page.

The BARs would also include a transfer of the funds from the CFD AMR Fund to the Capital Projects Fund. Per Resolution No. 25-1593, the Chief Financial Officer and/or designee is hereby authorized to process corresponding transfers (transfer appropriations) of all approved CIP Program expenditure appropriations, including fiscal year (FY) 2025/2026 and 2026/2027, and prior years’ carryover appropriations to Capital Projects Fund (Fund 4320) for purposes of consolidating CIP program expenditures under one fund.

If approved, the $65,000 appropriated through the proposed BARs to the CFD AMR Fund would supplement the existing Project budget that is available in the FY 2025/2026 CIP budget within the Capital Projects Fund, as summarized in Table 4 below.
