A PUBLIC HEARING has been scheduled, pursuant to Civil Code Section 2929.45, before the CITY OF MENIFEE CITY COUNCIL to consider confirming the abatement cost incurred for the real properties listed below and authorizing City staff to record a special assessment or lien against said properties if the owner fails to pay those costs in a timely manner.
Project Location
The Project site is the Krikorian Entertainment Complex located at 27387, 27459, and 27483 Newport Road, Menifee, CA 92584.
Description of Nuisance and Abatement
The City determined that the above-described properties were maintained in a condition constituting a public nuisance in violation of applicable laws and ordinances. After notice and failure to abate by the responsible party, the City caused the nuisance to be abated.
Proposed Costs and Amount of Lien / Assessment
The City seeks to recover the actual and reasonable costs incurred in performing the nuisance abatement, including administrative costs, in the total amount of $420,527.25.
An itemized report of the costs is on file with the Building and Safety Department and is available for public inspection during normal business hours.
Pursuant to Civil Code § 2929.45, the proposed lien or assessment does not exceed the actual and reasonable costs of nuisance abatement, and the costs are proposed to be adopted by the City Council at this public hearing.
The determination of the City Council is final and binding. Judicial review of the decision is subject to the provisions and time limits set forth in California Code of Civil Procedure sections 1094.6 et seq.

The confirmation of the final statement of costs in the amount of $420,527.25 to abate the public nuisance at the above-described properties and authorization for the placement of a special assessment or lien on the real property in case of delinquency.
The determination of the City Council is final and binding. Judicial review of the decision is subject to the provisions and time limits set forth in California Code of Civil Procedure sections 1094.6 et seq.
Any person wishing to comment on the proposed Project may do so in writing between the date of this notice and the public hearing and be heard at the time and place noted above. All comments must be received prior to the time of public hearing. All such comments will be submitted to the City Council, and the City Council will consider such comments, in addition to any oral testimony, before making a decision.
If this is challenged in court, the issues may be limited to those raised at the public hearing, described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing.
Be advised that as a result of public hearings and comment, the City Council may amend, in whole or in
part, the proposed action. Accordingly, the designations, development standards, design or improvements, or any properties or lands within the boundaries of the proposed Project, may be changed in a way other than specifically proposed.
The property owner and any interested persons may appear at the hearing and present objections or evidence regarding the proposed lien or assessment, the amount of costs, or the procedure followed.
