RECOMMENDED ACTION

1. Approve and authorize the City Manager to execute Amendment No. 2 to the Professional Services Agreement with TKE Engineering, Inc., for the Garbani Road Drainage Improvements Project, Capital Improvement Program Project No. 25-09, increasing the compensation by $31,829.00 for a total not-to-exceed amount of $341,546.40 and extending the agreement term through June 30, 2027.

DISCUSSION
The Garbani Road Drainage Improvements Project, Capital Improvement Program (CIP) Project No. 25-09, (Project) is located approximately 500 feet to the east of the intersection of Murrieta Road and Garbani Road. The Project consists of the design and construction of approximately 200 linear feet of drainage undercrossing at Garbani Road to replace the existing Arizona drainage facility located adjacent to Menifee Valley Middle School. The existing Arizona crossing serves as a roadway for most of the year but was also designed to allow stormwater to flow over the roadway surface during storm events, which impedes sidewalk access and presents a major obstacle for students traveling to the school. The Project would address this safety concern by replacing the existing crossing with an underground culvert system designed to accommodate storm water for 100-year storm events. The Project is identified as a high priority in the City’s Master Drainage Plan and aligns with the City’s Strategic Plan priority of maintaining a Safe and Vibrant Community.

On January 15, 2025, the City Council approved a Professional Services Agreement (Agreement) with TKE Engineering, Inc. (TKE) to provide design and environmental services for the Project.

The Agreement was approved in a total not-to-exceed amount of $297,789.00 and a term for services to be provided through June 30, 2026. Since the approval of the original Agreement, one additional amendment has been administratively approved to increase the total compensation to

cover additional subsurface investigation services. Additional assistance is now needed for right- of-way (ROW) acquisitions to secure permanent project easements and establish temporary construction easements. ROW acquisition services include, but are not limited to, ordering and reviewing title and appraisal reports, property owner negotiations, and managing escrow actions.

Proposed Amendment No. 2 would update the scope of the Agreement to include the tasks associated with ROW acquisition, would extend the term of the agreement through June 30, 2027, and would increase TKE’s agreement by $31,829.00, bringing the total not-to-exceed amount of the Agreement to $341,546.40. TKE’s amendment history for the Project is summarized in Table 1 below.
