DISCUSSION
Tract Map 37391 (TM37391), also known as Legado (Development), is an approved subdivision consisting of 331 gross acres to be subdivided into 18 lots for residential, commercial, and park use, and 28 lots for roads and utilities. TM37391 was recorded to establish the Project’s planning areas to be further subdivided in the future. The Development is located east of Encanto Drive, south of Rouse Road, west of Antelope Road, and north of Chambers Avenue, as shown in the attached Legado Site Map.

In 2024, Lennar Homes of California, LLC (Lennar) purchased Phase 1 of the Development, entered into improvement agreements with the City for the construction of backbone infrastructure, and began preparing three tract maps within Phase 1. These tract maps (37409-1, 37409-2, 37409-3) were approved by City Council on April 16, 2025.

BLC Fleming, LLC (Developer) is now developing Phase 2 (Project). Tract Map 37409-4 (TM37409-4) is a proposed subdivision of 22.67 gross acres of land into 84 single-family residential lots and a future 2.05 acre community park (East Park). TM37409-4 is located south of Rouse Road and east of Sherman Road, as shown in the attached Project Site Map.

The Developer is now requesting approval and filing of the final map for TM37409-4 and approval of the associated Subdivision Improvement Agreement (Agreement) as required by the Project’s conditions of approval. The Agreement requires that improvement securities be posted to guarantee the completion of the required onsite and offsite improvements. The Agreement requires that public improvements be completed within 24 months from the date of City Council approval.

Pursuant to Lennar’s amended Development Agreement (DA) associated with TM37409-4, the East Park improvements are required to be completed prior to the issuance of the 95th certificate of occupancy for Phase I. To satisfy this requirement and ensure compliance with the DA, Lennar is proposing to post improvement security for the required landscape improvements within the TM37409-4 East Park area.

Although Lennar does not hold title to the portion of property on which the East Park improvements would be constructed, they have entered into a license agreement with the Developer, authorizing Lennar to post bonds on behalf of the Developer-owned property. This arrangement allows the required improvements to be secured and constructed in accordance with the DA schedule.

As the fee owner of the property, the Developer would execute the proposed Landscape Improvement Agreement (LIA) associated with the East Park improvements. The bonding provided by Lennar, in conjunction with the executed LIA by the Developer, ensures that the required improvements are financially guaranteed and that the City’s interests are adequately protected. Acceptance of East Park would be brought forward to City Council at a future meeting following completion of construction.

Staff has reviewed the Developer’s request and determined that the Agreement meets the Project’s conditions of approval. A summary of the bonds being posted to guarantee the required improvements are shown in the following tables.
