Menifee Boardwalk Project City of Menifee
Initial Study / Mitigated Negative Declaration March 2026 1 Mitigation Monitoring and Reporting Program
The California Environmental Quality Act (CEQA) quires a Lead Agency to adopt a “reporting or monitoring program for changes to the project or conditions of project approval, adopted in order to mitigate or avoid significant effects on the environment.” The City of Menifee is the Lead Agency for the Project and is, accordingly, responsible for administering and implementing the Mitigation Moni toring and Reporting Program (MMRP). A Lead Agency may delegate reporting or monitoring responsibilities to another public agency or private entity that accepts the delegation; however, until the measures have been completed, the Lead Agency remains respon sible for ensuring that implementation of the measures occurs in accordance with the program. This MMRP is intended to track and ensure compliance with adopted mitigation measures during implementation of Major Plot Plan (No. PLN24 -0118), Tentative Map (No . 39000), minor conditional use permit (No. PLN25 -0112), and Sign Program (No. PLN24 -0148) herein referred to as the Menifee Boardwalk Project or the “Project.” For each mitigation and recommendation measure included in the Initial Study/Mitigated Negative Declaration (IS/MND) prepared for the Project, inclusive of any revisions made pursuant to comments received on the Draft IS/MND, specifications are made herein that identify the action required, the monitoring that must occur, and the agency or department responsible for oversight.

EXHIBIT "B"
Menifee Boardwalk Project City of Menifee Initial Study / Mitigated Negative Declaration March 2026 2 Mitigation Measure / Recommendation Measure Implementation Timing Responsible Monitoring Party Monitoring / Reporting Method Compliance Verification Biological Resources BIO-1 Burrowing Owl Pre-Construction Survey. Prior to issuance of a grading permit, the applicant shall perform a preconstruction survey that shall be conducted within 30 days prior to ground disturbance to avoid direct take of burrowing owls. If the results of the survey indicate that no burrowing owls are present onsite, then the Project may move forward with grading, upon Planning Department approval. If burrowing owls are found to be present or nesting onsite during the preconstruction survey, then the following recommendations must be adhered to: Exclusion and relocation activities may not occur during the breeding season, which is defined as March 1 through August 31, with the following exception: From March 1 through March 15 and from August 1 through August 31 exclusion and relocation activities may take place if it is proven to the Lead Agency and/or appropriate agencies (if any) that egg laying or chick rearing is not taking place. This determination must be made by a qualified biologist.

Prior to issuance of grading permit City Planning Division Survey Report BIO-2 Pre-Construction Nesting Bird and Raptor Survey. If possible, ground disturbing activities and vegetation removal shall be timed to occur between September 1–January 31, which is outside the bird and raptor nesting season. If ground disturbing activities or vegetation removal (including tree trimming) are scheduled between February 1–August 31, which is the bird nesting season, a preconstruction survey for nesting birds shall be conducted within 72 hours prior to construction activities. The survey shall be conducted by a qualified biologist with prior experience conducting nesting bird surveys for construction projects. The study area shall include the affected area and suitable habitat within a 500-foot buffer, or a buffer size determined by the qualified biologist based on level of proposed disturbance and access. If no active nests are found, no additional measures are required. If active nests are found, the biologist shall map the location and document the species and nesting stage. A no-work buffer shall be established around the active nest as determined by the qualified biologist and based on the species’ sensitivity to disturbance and the type and duration of the disturbance. No construction activities shall occur within the no-work buffer until the biologist has determined the nest is no longer active. 72 hours prior to start of construction City Planning Division Survey Report

Menifee Boardwalk Project City of Menifee Initial Study / Mitigated Negative Declaration March 2026 3 Mitigation Measure / Recommendation Measure Implementation Timing Responsible Monitoring Party Monitoring / Reporting Method Compliance Verification Cultural Resources / Tribal Cultural Resources CUL-1 Unanticipated Discovery of Cultural Resources. Should archaeological resources (sites, features, or artifacts) be exposed during construction activities for the Project, a qualified archaeologist shall be retained to assess the find. Depending on the significance of the find, the archaeologist may simply record the find and allow work to continue. In the event that an identified cultural resource is of Native American origin, the qualified archaeologist shall consult with the Project applicant and the City of Menifee to implement Native American consultation procedures. If the discovery proves significant under CEQA, additional work such as preparation of an archaeological treatment plan, testing, or data recovery may be warranted.

CUL-2 Unanticipated Discovery of Human Remains. In accordance with Section 7050.5 of the California Health and Safety Code, if human remains are found, the County Coroner shall be notified within 24 hours of the discovery. No further excavation or disturbance of the site or any nearby area reasonably suspected to overlie adjacent remains shall occur until the County Coroner has determined, within two working days of notification of the discovery, the appropriate treatment and disposition of the human remains. If the remains are determined to be Native American, the Coroner shall notify the Native American Heritage Commission (NAHC) in Sacramento within 24 hours. In accordance with California PRC, Section 5097.98, the NAHC must immediately notify those persons it believes to be the Most Likely Descendant (MLD) from the deceased Native American. The MLD shall complete their inspection within 48 hours of being granted access to the Site. The MLD would then determine, in consultation with the property owner, the disposition of the human remains.

Menifee Boardwalk Project City of Menifee Initial Study / Mitigated Negative Declaration March 2026 4 Mitigation Measure / Recommendation Measure Implementation Timing Responsible Monitoring Party Monitoring / Reporting Method Compliance Verification Geology and Soils GEO-1 Qualified Professional Paleontologist. Prior to excavation, the Project Applicant shall retain a Qualified Professional Paleontologist, as defined by the Society of Vertebrate Paleontology (2010), who shall direct all mitigation measures related to paleontological resources. Paleontological Worker Environmental Awareness Program. Prior to the star of construction, the Qualified Professional Paleontologist or their designee shall conduct a Paleontological Worker Awareness Program (WEAP) training for construction personnel regarding the appearance of fossils and the procedures for notifying paleontological staff should construction personnel discover fossils. Paleontological Monitoring and Salvage. Full-time paleontological monitoring shall be conducted during ground-disturbing construction activities within previously undisturbed sediments assigned high paleontological sensitivity. Paleontological monitoring shall be conducted by a paleontological monitor with experience with collections and salvage of paleontological resources and who meets the minimum standards of the Society of Vertebrate Paleontology (2010) for a Paleontological Resources Monitor. The Qualified Professional Paleontologist may recommend that monitoring be reduced in frequency or ceased entirely based on geologic observations, such as the recognition that sediments disturbed by Project activities consist of disturbed and/or non-fossil-bearing fill sediments. Such decisions shall be subject to the review and approval of the City. In the event of a fossil discovery by the paleontological monitor or construction personnel, all construction activity within 50 feet of the find shall cease, and the Qualified Professional Paleontologist shall evaluate the find. If it is determined that the find is scientifically significant, the following shall be completed: Fossil Salvage. The paleontological monitor shall salvage (excavate and recover) the find to protect it from damage/destruction. Typically, fossils can be safely salvaged quickly by a single paleontological monitor with minimal disruption to construction Prior to excavation City Planning Division Executed contract between Applicant and Qualified Professional Paleontologist; WEAP training; Paleontological Mitigation Report

Menifee Boardwalk Project City of Menifee Initial Study / Mitigated Negative Declaration March 2026 5 Mitigation Measure / Recommendation Measure Implementation Timing Responsible Monitoring Party Monitoring / Reporting Method Compliance Verification activities. In some cases, larger fossils (such as complete skeletons or large mammal fossils) require more extensive excavation and longer salvage periods. Bulk matrix sampling may be necessary to recover small invertebrates or microvertebrates from within paleontologically sensitive deposits. After the find is salvaged, construction activity may resume. Fossil Preparation and Curation. Fossils shall be identified to the lowest (most-specific) possible taxonomic level, prepared to a curation-ready condition, and curated in a scientific institution with a permanent paleontological collection along with all pertinent field notes, photos, data, and maps. Fossils of undetermined significance at the time of collection may also warrant curation at the discretion of the Qualified Professional Paleontologist. Final Paleontological Mitigation Report. Upon completion of ground-disturbing activities (or laboratory preparation and curation of fossils, if necessary), the Qualified Professional Paleontologist shall prepare a final report describing the results of the paleontological monitoring efforts. The report shall include a summary of the field and laboratory methods employed; an overview of Site geology; and, if fossils were discovered, analysis of the fossils, including physical description, taxonomic identification, and scientific significance. The report shall be submitted to the City and, if fossil curation occurred, the designated scientific institution. Hazards and Hazardous Materials / Transportation TRA-1 Fair Share Contribution. Prior to the issuance of a Certificate of Occupancy, the Project Applicant shall pay the Project’s fair share amount consistent with the City of Menifee’s LOS Traffic Study Guidelines subject to final review and approval by the City Engineer and in conjunction with all other applicable transportation fees (including, but not limited to, the City’s development impact fees).

Prior to the issuance of grading permits, the Project Applicant shall prepare a Traffic Management Plan (Construction TMP) for approval by the City of Menifee Traffic Engineer. The Construction TMP shall include measures to minimize potential safety impacts during the short-term construction process if partial or full lane closures are required. The Construction TMP shall specify that on direction of travel in each direction on adjacent roadways must always be maintained during Project construction activities. If full lane closures are required and one direction of travel in each direction cannot be maintained, the Construction TMP shall identify planned detours. The Construction TMP shall include measures such as construction signage, limitations on timing for lane closures to avoid peak hours, temporary striping plans, and use of construction flag-person(s) to direct traffic during heavy equipment use. The Construction TMP shall in incorporated into Project specifications for verification prior to final plan approval.
