8 WHEREAS, all other legal prerequisites for the adoption of this resolution have occurred.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Menifee, California finds as follows:

Section 1: The City of Menifee’s City Council hereby makes the following findings for PP No. PLN24-0118 in accordance with Title 9, Article 2, Chapter 9.80.70, “Findings for Approval Plot Plan” of the City of Menifee Comprehensive Development Code:

Finding 1 - The proposed project is consistent with the adopted General Plan and Menifee Village Specific Plan No. 158.

The Project site currently has a General Plan land use designation of Menifee Village Specific Plan (MVSP). The intent of the designation is to identify areas where a mixture of residential, commercial, office, civic, entertainment, educational, and/or recreational uses or other uses are planned. The proposed development includes a daycare, retail, medical office, and restaurants and will be consistent with the designation. The Project will be consistent with the vision, goals, and policies of the MVSP.

In addition, the Project is consistent with the following City of Menifee General Plan policies:
LU-1.1: Concentrate growth in strategic locations to help preserve rural areas, create place and identity, provide infrastructure efficiently, and foster the use of transit options.

The proposed Project is in close proximity to the center of the City and Interstate 215. The location is well suited for commercial development.

Its location will promote easily accessible routes for employees and delivery personnel, and the location helps concentrate activity and development near the major transit corridors of the City as opposed to the rural areas or traveling through residential areas. CD-3.5  Design parking lots and structures to be functionally and visually integrated and connected; off-street parking lots should not dominate the street scene.

Perimeter landscaping has been provided to visually screen the parking lots, drive aisles, and compliment the building design from surrounding roadways. The massing of the building will also be significant and will be a new landmark in the City of Menifee. The architecture is thoughtfully designed and will be aesthetically integration consistent with the requirements of the specific plan.
CD-3.9  Utilize Crime Prevention through Environmental Design (CPTED) techniques and defensible space design concepts to enhance community safety.

The Project is required to submit a security plan for review by the Planning Division and Police Department. The site has been designed to limit concealed areas to allow for greater visibility and security.

8 CD-3.12: Utilize differing but complementary forms of architectural styles and designs that incorporate representative characteristics of a given area.

The architecture of the Project incorporates varied colors, recesses, material changes, varied roof lines, wall plane changes, accent materials, and other architectural treatments that break up wall areas to avoid any long expanses of blank, monotonous walls. The building is designed to prioritize employee safety and functionality. Nonetheless, the building is still designed to meet the requirements of the architectural design guidelines set forth in the MVSP such as building form, roof form, massing and articulation, materials and colors, windows, doors, and entries. Landscaping along the building edges will also help to compliment the design.
CD-3.14 Provide variations in color, texture, materials, articulation, and architectural treatments. Avoid long expanses of blank, monotonous walls or fences.

The architecture of the Project incorporates varied colors, recesses, material changes, varied roof lines, wall plane changes, accent materials, and other architectural treatments that break up wall areas to avoid long expanses of blank, monotonous walls. Screen walls have also been designed to incorporate architectural elements and robust landscape from the building for compatibility.

Finding 2 - The proposed project meets all applicable standards for development and provisions of this Title.

Per Section 9.80.020 “Applicability” of the Development Code, new construction of non-residential projects more than 2,500 square feet of floor area requires the processing of a Plot Plan. The Plot Plan is for the site and architectural review, to allow for the construction of a building that surpasses this threshold. The proposed Project meets all applicable standards of development and operation of the MVSP, City’s Zoning Code (Title 9), including but not limited to, parking requirements, setbacks, landscape coverage, and height requirements of the applicable development standards. Moreover, the Project was reviewed against and meets all the regulations in the MVSP and General Plan.

Finding 3 - The establishment, maintenance, or operation of the proposed project will not be detrimental to the health, safety, or general welfare of people residing or working in the neighborhood of such use or to the general welfare of the City.

To ensure the Project would not affect the general health, safety and/or welfare of the community, an IS/MND was prepared to analyze potential impacts to the surrounding people residing or working in the community.

Impacts that were found to be significant were able to be mitigated to a level less than significant with mitigation measures incorporated.

Section 2: The City of Menifee’s City Council hereby makes the following findings for the requested CUP No. PLN25-0112 in accordance with Title 9, Article 2, Chapter 9.40.070 “Findings for Approval” of the City of Menifee Development Code:

Finding 1 - Consistency with the Menifee Village SP. The proposed design and location of the conditional use is consistent with the adopted General Plan and specific plan:

The Project site currently has a General Plan land use designation MVSP.

The intent of the designation is to identify areas where a mixture of residential, commercial, office, entertainment, educational, and/or recreational uses or other uses are planned. The proposed development of a mixed-use complex, which proposes daycare, retail, medical office, retail, and restaurants, will be consistent with the designation. The Project will be consistent with the vision, goals, and policies of the MVSP.

Finding 2 - The proposed design and location of the conditional use meet all applicable standards of development and operation of the specific plan.

The Project site zoning classification is MVSP. The commercial portion of the MVSP encompasses 84 acres in four locations to provide shopping opportunities in the immediate area, which will offer entertainment uses that will complement commercial retail uses and higher density housing options that encourage walkability. As a mixed-use commercial development, the proposed Project will meet the intent of the MVSP.

The proposed Project meets all the Development Code standards, including but not limited to, parking requirements, setbacks, landscape coverage, floor area ratio (FAR) and height requirements of the MVSP. The proposed Project is compatible with the surrounding land uses, General Plan Land Use designations, and Zoning classifications subject to City Council approval. The Project incorporates architecture and landscaping which will enhance the area.

Finding 3 - That the proposed site is adequate in size and shape to accommodate the conditional use in a manner that is compatible with existing and planned uses in the vicinity.

The Project site is adequate in size to accommodate the uses and consists of 6.02 acres. The Project is compatible with the surrounding land uses, General Plan land use designations, and zoning classifications and is adequately shaped, designed and located to accommodate the proposed Menifee Boardwalk - Entitlement

The Project is compatible with the surrounding land uses, MVSP, General Plan Land Use designation, and Zoning classification and is designed and located to accommodate the proposed use. As noted above in Findings 1 and 2, the Project includes uses that are compatible and serve surroundings residents and businesses.

The Project has been reviewed by a variety of Departments to ensure compliance with applicable regulations, including, but not limited to Community Development, Engineering and Public Works, Office of the Fire Marshall, Police, Riverside County Environmental Health, and Eastern Municipal Water District. These Departments have also provided conditions of approval as appropriate to ensure compliance with applicable regulations.

Therefore, the Project would not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the Project vicinity. The Project is consistent with the MVSP.

Findings 5 - Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of CEQA.

An IS/MND has been completed for the Project and no significant impacts were identified with the incorporation of standard conditions of approval and mitigation measures (as listed in the Mitigation Monitoring Reporting Program [MMRP]). The PP and CUP at issue are consistent with the MND, which the City Council has considered as part of its proceedings. No new environmental impacts have been identified, and no further environmental review is required for this project.

A MMRP was prepared and identifies all mitigation measures that will be required for the Project.

Section 3: The City of Menifee’s City Council hereby makes the following Findings for TPM No. 39000 (PLN26-0037) in accordance with Title 7, Article 2, Chapter

7.20.090, “Findings for Approval Tentative Maps” of the City of Menifee Comprehensive Development Code:

8 In addition, the Project is consistent with the following City of Menifee General Plan policies:
LU-1.1: Concentrate growth in strategic locations to help preserve rural areas, create place and identity, provide infrastructure efficiently, and foster the use of transit options.

The proposed Project is in close proximity to similar uses which are already established along Newport Road. This focuses more growth in the center of the City instead of the edges and rural areas. LU-2.1 Promote infill development that complements existing neighborhoods and surrounding areas. Infill development and future growth in Menifee is strongly encouraged to locate within SP areas to preserve the rural character of rural, estate, and small estate residential uses.

The proposed Project would be located along Newport Road in the MVSP. The quick-serve drive-thru coffee shop, medical, restaurant, daycare, and retail building will complement other commercial uses along the corridor and will help to preserve growth in the center portions of the City.

Finding 2 - The site is physically suitable for the type and proposed density of development proposed by the tentative map.

The site is physically suitable for the proposed development and density, as it can accommodate the planned commercial uses, infrastructure improvements, and parcel layout identified in the tentative map without posing significant constraints related to topography, access, or utility availability.

Finding 3 - The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat.

The design of the commercial subdivision and the proposed improvements are not expected to result in significant environmental impacts or cause substantial or avoidable harm to fish, wildlife, or their habitats as the site was previously disturbed.

Finding 4 - The design of the subdivision and the type of improvements are not likely to cause serious public health problems.

The design of the subdivision and the proposed improvements are not anticipated to pose significant public health risks, as the Project includes standard infrastructure, utility connections, and site design measures consistent with City and public health requirements. The Project has been reviewed by a variety of Departments to ensure compliance with applicable regulations, including but not limited to Community Development, Engineering and Public Works, Office of the Fire Marshall, Police, Riverside County Environmental Health, and Eastern Municipal Water District. 8 of these Departments have provided conditions of approval as appropriate to ensure compliance with applicable regulations.

Finding 5 - The design of the subdivision and the type of improvements will not conflict with easements acquired by the public at large for access through or use the property within the proposed subdivision, or the design of the alternate easements which are substantially equivalent to those previously acquired by the public will be provided.

The design of the commercial subdivision and proposed improvements will not conflict with existing public easements. Where necessary, alternative easements of equivalent function and location will be provided to ensure continued public access and utility use.

Section 4:Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of CEQA.

An IS/MND has been completed for the project and adopted by the City Council. The PP, CUP, and TPM at issue are consistent with the IS/MND, which the City Council has considered as part of its proceedings.
