CITY OF MENIFEE
SUBJECT: Short-list Extensions and Agreement Amendments for On- Call Services for the Public Works Engineering and Capital Improvement Program Divisions for Fiscal Year 2026-2027 MEETING DATE: June 3, 2026
TO: Mayor and City Council
PREPARED BY: Kristen Jensen, Financial Analyst
REVIEWED BY: Nick Fidler, Public Works Director
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------
RECOMMENDED ACTION
1. Approve the extension of the On-Call Short Lists for the Public Works Engineering and Capital Improvement Program divisions through June 30, 2027; and
2. Authorize the City Manager to execute amendments to Master Agreements for Professional On-Call Services with the qualified firms established on the approved On-Call Short Lists for the Public Works Engineering and Capital Improvement Program Divisions, extending all agreements through June 30, 2027, and increasing the not-to-exceed amount for agreements as needed for Fiscal Year 2026/2027; and
3. Authorize the Finance Department to issue purchase orders on an as-needed basis in the aggregate of the not-to-exceed amount of the amended agreements.
DISCUSSION
Background
The Public Works Land Development Engineering (Engineering) Division is responsible for processing and approving developer submittals for private residential, commercial, and industrial developments. Processing of submittals often requires that multiple plan checks and field inspections be performed to comprehensively review all aspects of a project’s proposed onsite and offsite improvements and engineering studies.
The Public Works Capital Improvement Program (CIP) Division is responsible for the planning, design, and implementation of public infrastructure improvement projects throughout the City. CIP projects require the support of technical and specialized professional services to move a project through all phases from concept to construction completion. These services include, but are not

limited to, environmental assessments, design services, labor compliance, right-of-way acquisition, grant management and materials testing. CIP is currently implementing 59 projects in various active phases of planning, design, construction, and close-out with currently approved budgets totaling over $114M for capital improvement projects.
Both divisions rely on support from professional service firms to provide technical review and expert assistance for delivering safe, compliant, and well-planned projects. In 2022, the Engineering and CIP divisions administered separate formal Request for Qualification (RFQ) processes to establish approved short-lists of qualified firms in various categories of on-call professional services. As a result of the RFQ solicitations, short-lists were approved by City Council for Engineering on August 17, 2022, and for CIP on September 21, 2022. The approved short-lists are included as attachments to this report and were established for use through the end of Fiscal Year (FY) 2025/2026.
In an effort to streamline processes and ensure the highest and best use of available resources, City Council also approved the use of a multi-year Master Agreement for Professional On-Call Services (Agreement) on June 21, 2023, to be utilized by both Engineering and CIP divisions with pre-qualified professional service firms. The Agreement was previously approved as to form by the City Council and the City Attorney’s Office and contain provisions stating that the continuance of the Agreement is contingent on the allocation of funding in the City’s annual budget and allow for termination without breach if no funding or insufficient funding is allocated for the Agreement each year. The Agreement also contains provisions to prevent unlawful awards of contracts and purchase orders.
Due to the volume and complexity of Engineering and CIP projects and given the time required to effectively establish new short-lists for on-call services, staff is requesting to extend the currently approved short-lists for both Engineering and CIP for 12 months through June 30, 2027.
Approval of this request would allow continuity of project support with on-call firms currently assigned to support ongoing project tasks. Approval would also allow staff the time required to properly notice and prepare new RFQs for each division, solicit, evaluate responses, and ultimately establish new short-lists for on-call services for each division effective July 1, 2027.
This extension request would also allow staff to assess additional on-call service needs to included in a future RFQ and align work planning for future on-call professional service budget needs with the FY 2027/2028 and 2028/2029 biennial budget development process.
Master Agreement Amendments
Term Extensions
Engineering previously issued 16 on-call Agreements and CIP issued 19 Agreements for pre- qualified firms included on the respective division’s approved on-call short-list. The terms for all Agreements issued are currently set to expire on June 30, 2026. In concert with the requested extension of the short-lists themselves, staff is proposing that all approved short-list firms’ Agreements also be amended to reflect a term ending date of June 30, 2027.

Compensation Adjustments
Staff evaluated all existing Agreements to determine if the current compensation not-to-exceed (NTE) amount of each Agreement was expected to be sufficient to support anticipated work through FY 2026/2027. Evaluations included estimating needs upon the type of service to be provided, the historical use of each service, and the anticipated future need for services required based on the types of project tasks expected through June 30, 2027. Based on those reviews, additional amendments to total Agreement NTE compensation amounts are being requested for seven on-call firms supporting the Engineering Division. All other Engineering Agreements, and all CIP related Agreements, are expected to have sufficient capacity to provide services within their current NTE amounts.
A summary of firms, type of service(s) provided, proposed term extension, and any proposed adjustments to NTE amounts for on-call services Agreements are provided in Table No. 1 for Engineering and Table No. 2 for CIP, below. It is important to note that amounts shown in the Full Term NTE Amount column in both tables represent the proposed NTE compensation amount for the full four-year of term of each Agreement.

Effective January 1, 2026, new State requirements approved through Assembly Bill 339 (AB339) established that local agencies are required to notify union representatives at least 45 days in advance of issuing a request for proposals, request for quotes, or renewing or extending an existing contract for services that fall within the scope of work of represented employees.
AB339 also establishes notification exemptions for certain public works contracts and agreements related to the provision of architecture or engineering related service. In an effort to ensure full compliance with AB339 and in the spirit of transparency, notification of all on-call service Agreement amendments requested through this agenda item were provided to the employee association representatives by the Human Resources Department on April 8, 2026. The 45-day notification period was met as of May 23, 2026.
Sample Agreement amendment forms were prepared, reviewed by the City Attorney’s office, and provided to the employee association as part of the AB339 notification package. Upon approval of this item, those same forms, attached as Sample A Template for term extensions only and Sample B Template for term extensions with compensation adjustments, would be used to amend the Engineering and CIP Agreements discussed above.

FISCAL IMPACT
There is no additional fiscal impact associated with item. Funding for the Engineering Division’s proposed Agreement Amendments is included in the previously approved FY 2026/2027 Operating Budget and costs associated with work performed under the Agreements would be offset by developer fees and deposits collected for each specific project and type of review.
Funding for the CIP Division’s proposed Agreement Amendments would be supported by specific project budgets established through the approved FY 2025-2030 Capital Improvement Program document for all fiscal years.
It is important to note that purchase orders would only be issued for services under the amended Agreements after confirmation of budget availability and for amounts within the NTE amounts approved through this item by the City Council.
