CITY OF MENIFEE
SUBJECT: Animal Services Overview and Backyard Breeder Regulations MEETING DATE: July 15, 2026
TO: Mayor and City Council
PREPARED BY: Heriberto Gutierrez, Police Captain
REVIEWED BY: David Gutierrez, Police Chief
APPROVED BY: Armando G. Villa, City Manager
-------------------------------------------------------------------------------------------------------------------------------
RECOMMENDED ACTION
1. Receive a report regarding current animal control services, licensing structures, service trends, and backyard breeder regulations to continue the support of proactive animal control and animal welfare services within the City.
DISCUSSION
Animal control services are an integral part of Menifee’s on-going commitment to being a safe and vibrant community. In its full form, animal control provides a core public health and safety function but also focuses on animal protection and welfare. Proactive and responsive animal control services leverage field and sheltering services with on-going strategies such as managed intake, targeted spay/neuter programs, and forward-looking policies. Supporting animal field services and shelter options from becoming overburdened with animal in-takes is vital to the effective application of public resources.
In January 2026, City Council requested a future agenda item to discuss backyard breeder regulations. To provide some context of the impacts and/or elements to consider when discussing backyard breeder regulations, a summary of the current animal control services, licensing structure, animal control service trends, and other programs is included as part of this staff report.
Current Animal Control Services
Oversight of animal control services falls within the purview of the Menifee Police Department and its Code Enforcement division. The Code Enforcement Manager represents the City of Menifee as an Executive Management Committee Member within a formalized Joint Powers Agreement for the Southwest Communities Financing Authority. The Code Enforcement Manager also maintains communications with representatives from contracted animal control service providers.
Menifee residents receive animal control services from two main sources:

1. Field Services
2. Sheltering Services
Field Services (Contract Services with Animal Friends of the Valley (AFV)) Beginning in 2020, the City directly contracts with AFV for animal control field services. The current contract services agreement for field services is valid through June 30, 2027.
Field services provided by AFV include:
•Investigating animal-related law violations and applicable enforcement action. •Rescuing stray, sick, or injured animals.
•Responding to emergency calls on a 24/7 basis.
•Impounding and boarding stray animals.
•Enforcing rabies vaccination and licensing requirements.
The purpose of animal field services is to provide the community with trained animal field staff to address public safety concerns, protect animal welfare, enforce municipal code requirements, and respond to domestic animal and related activities. Field services function as the principal intake for transporting stray, injured, and rescued animals to an animal shelter for medical care, reunification and/or adoption. Animal licensing helps support and demonstrate compliance with vaccination and other requirements, aligns with the focus on public health and safety, and is incorporated as part of the field services provided by AFV.
Sheltering Services (Member of regional Joint Powers Authority (JPA)) As of 2020, animal sheltering services are facilitated by the City’s participation in the Southwest Financing Authority Joint Powers Authority (SCFA JPA). The JPA, first established in 2004, included the unincorporated communities within the County of Riverside, and other member cities such as Canyon Lake, Murrieta, Temecula, Wildomar, and Lake Elsinore. The City of Menifee was accepted as a member of the JPA on November 1, 2020. Through the JPA, the member cities cooperatively share powers and pool resources, to support the availability of an animal shelter that supports all the member cities.
The SCFA JPA shelter is in the City of Wildomar, where all Menifee animal intakes are housed and processed. This allows for a localized resource for pet owner reunification, adoptions, and other sheltering services.
Other benefits of participation in the JPA included financing ($15.105 million in bonds issued in 2008) for the current shelter by sharing of costs, as well as a regionalized approach in delivery of service. Each city has a designated elected official representative as a voting JPA board member, and the JPA board meets two times a year. As previously indicated, the City of Menifee also has representation from an Executive Management Committee member within the JPA. This committee meets as necessary to review the operations and business of the JPA.
Daily operations of the JPA shelter are provided by AFV based on an existing Animal Shelter Operations Agreement, first entered into in 2010. A more recent agreement executed in June 2025 for the period of 2025 through 2030 includes the option of up to three one-year extensions.
The agreement pertains only to sheltering services, as the individual cities, including Menifee, contract separately with AFV for animal field services.

Sheltering services made available by the JPA generally include the following:
•Impoundment, admittance, receiving, care, custody and feeding of any and all domestic animals, to include wildlife as may be delivered and/or received at the shelter. •Redemption, treatment, sale, adoption, and/or disposal of any and all animals. •Counseling and advising animal guardians.
•Identifying animals impounded into the shelter and conducting a thorough search for such animals’ guardians.
•Posting photographs of newly impounded animals on the shelter website, within 24 hours of impoundment (excluding Sundays and holidays).
•Ensuring that all dogs, four months or older, returned to guardian released from the shelter are licensed, and if applicable to specific jurisdiction, microchipped. •Maintenance of up-to-date records of all animals processed through the shelter (impounded, adopted, quarantined, euthanized, animals processed at immunization clinics and animal receiving spay/neutering services.)
•Care and maintenance of the shelter (land and buildings). •Medical services for injured/sick animals or arranging transfer of animals to the appropriate agency.
Existing Animal Licensing Fees, Spay/Neuter and Microchipping Requirements Animal licensing helps provide legal identification for pets, prove compliance with vaccination requirements, and ensures quicker pet reunification. As indicated in the preceding sections, animal licensing is currently administered by AFV as part of the contract field services. Licensing fees are directly remitted to AFV. Under the existing contract, AFV retains all licensing revenue which is later applied to field services billed as a monthly flat amount. Alternatively, during contract negotiations the City reviewed the option of receiving credits for licensing revenue to offset monthly billings but ultimately elected the flat monthly billing option.
Chapter 10.04 of Menifee Municipal Code (MMC) governs all matters related to the maintenance and licensing of dogs and cats within the city. Per the municipal code, licensing of all dogs is mandatory, licensing of cats is optional. This chapter includes the imposition of licensing fees specifically within Section 10.04.260, which indicates licensing fees “shall be in effect until the City Council shall by resolution fix some other fees upon the basis of a cost analysis as determined by the City of Menifee, or where applicable, pursuant to a change in the applicable laws and regulations of the state of California, or where applicable, both”. The following table summarizes the City’s current dog licensing fees compared to the other southwest Riverside County JPA member cities.

Corresponding licenses are categorized within two categories:
•Altered (Spayed/Neutered): $16 (dog) (Base Standard Fee) •Unaltered (Not Spayed/Neutered): $80 (dog) (Base Standard Fee) Microchipping Requirements: All dogs and cats over the age of four months must be implanted with an identifying microchip. (MMC 10.04.140) Exceptions include:
•Dog/cat with a high likelihood of suffering serious bodily harm or death if implanted with the microchip identification. Owners must obtain proof from a California-licensed veterinarian.
•A dog or cat which would be impaired in its athletic ability or performance if implanted with the microchip identification. Owners must obtain proof from a California-licensed veterinarian.
•A dog or cat that is kenneled or trained within Riverside County but is owned by an individual that does not reside in Riverside County.
Menifee Animal In-Take/Sheltering Data Analysis and Trends In line with the City’s population growth, the City’s animal population also continues to grow.
Working with AFV and the City’s GIS team, staff reviewed Menifee Animal in-take data for the three most recent completed years, 2023 to 2025, to identify any notable trends including:
•Geographic location trends (animal pick-up)

•Spay/Neutered animal trends
•Dogs/cats reunited with owners
CHART 1: 2023, 2024 AND 2025 ANIMAL IN-TAKE NUMBERS
From 2023 to 2025, cat and dog in-takes represented between 81.58% to 77.24% of all animal in-takes processed by AFV.
TABLE 2: PERCENTAGE OF DOGS/CATS SPAYED/NEUTERERED AND REUNITED WITH OWNER
Description 2023 2024 2025
% of Dogs in-take Not Spayed/Neutered 80.99% 71.40% 70.60% % of Cats in-take Not Spayed/Neutered 86.43% 85.49% 82.96% % of Dogs Reunited with Owner 11.73% 19.04% 17.03%
% of Cats Reunited with Owner 7.13% 2.88% 1.57%
Based on the data reviewed, some notable trends included the following:
- Over the three-year period the percentage of not spayed or neutered animals has averaged 74.33% for dogs and 84.96% for cats. Year to year, however, more dogs and cats are statistically shown to be spayed/neutered.
- The 3-year average of reunification with the pet owner for cats has been 3.86% and
15.94% for dogs. The less animals that are microchipped often results with reduced opportunities to reunite the animal with their respective owner; therefore, increasing sheltering times.
Proactive Animal Control Strategies
An important component of supporting sustainable animal control, both within field and sheltering services, includes the City of Menifee’s proactive approach of services and programs to encourage balanced and planned animal breeding and streamlined pet owner reunification.
Programs, such as spay/neuter programs provide the most effective and humane way to reduce shelter overcrowding. Similarly, microchipping programs support efforts to reunite lost pets with their owners, making lost dogs, for example, 2.5 times more likely to be reunited with their owner, 884

and lost cats 21.4 times more likely to be reunited with their owner according to the American Veterinary Medical Association.
Proactive animal control efforts include the following:
•Micro-chipping services made available at AFV.
•Spay/Neuter fee voucher program which allows Menifee residents the ability to benefit from up to two free spay/neuter procedures per household. •On-going distribution of Spay/Neuter vouchers during home visits by Animal Control Officers.
•AFV Information & Resource Booths at Menifee community events. •Partnership with Riverside County to host future Spay/Neuter Mobile Clinic events within city limits.
Through its partnership with AFV, a spay/neuter program was launched in April 2026. In its first iteration of the spay/neuter program, the city received high community interest. The 100 available appointments were taken within a two-week timespan. An additional 25 applications were waitlisted.
Additionally, the County of Riverside is working with our team for the future deployment of a mobile spay/neuter clinic within our city limits. This will provide mobile spay/neuter services on-site for an estimated 26 dogs and/or cats per event. Recognizing the response level to spay/neuter programs, staff will evaluate opportunities to continue these programs on a recurring basis.
As service demands increase, staff will continue to review operational models that support regulatory compliance, reduce shelter intake, and support proactive enforcement efforts. This includes expanded public education and outreach, proactive field enforcement and resource availability.
Backyard/Hobby/Reputable/Responsible Breeder Regulations Dog breeding in the United States is regulated to some extent both federally (Animal Welfare Act (AWA) of 1966), and by state legislation, including California Health and Safety Code 122045; known as the Polanco-Lockyer Pet Breeder Warranty Act. However, as summarized in the 2018 publication, Backyard Breeding: Regulatory Nuisance, Crime Precursor, by the Tennessee Law Review Association, federal and state law regulations, focus on regulation of large, commercial breeding activity, leaving small volume breeding existing as decentralized oversight, if any, and often unregulated. Local ordinances vary from city to city, with some establishing components such as required registration of litters and litter permits. While many others focus on kennel licensing requirements, where more than a certain number of animals are kept or maintained.
Against this regulatory patchwork, prolific backyard breeding activity can result in oversupply of animals and overpopulation of shelters. One additional challenge in identifying pervasive backyard breeding is that this is blended and often comingled with unintentional breeding, which results from unspayed/unneutered animals, where there may be no actual intent to breed.
Hobby Breeders vs. Backyard Breeders
The Menifee municipal code does not incorporate discussion and/or explicit allowance for “Backyard Breeders” and/or “Hobby Breeders”. These terms, while in some cases used almost interchangeably, carry slight distinctions, and for purposes of discussion are defined as follows:

This is further defined as the breeding of animals without proper knowledge, care, or resources and is often associated with prioritizing profit over animal welfare. - Hobby Breeder: Individual breeder who seeks to not alter their dog or cat to potentially breed the dog or cat and sell the offspring. These breeders do not have a kennel, cattery, or pet shop permit or license.
- Reputable/Responsible Breeder: A breeder who follows ethical breeding practices and prioritizes animal welfare. Adheres to health testing, proper care, and responsible sales practices.
Presently, the JPA member cities of Canyon Lake, Lake Elsinore, and Wildomar each have established hobby breeder licensing options, which essentially allow individuals to keep an unaltered dog or cat without violating the respective city’s mandatory spay/neuter ordinance.
Their respective hobby breeder licensing options also include a breeding restriction of those animals to one litter in any 12-month period. Additional requirements include required microchipping, vaccination against rabies, and an annual license fee of $200 per animal that is notably higher than their respective altered fees.
Other Riverside County areas, like Calimesa, Cathedral City, Eastvale, Hemet, and Riverside City issue licenses as altered or unaltered licenses, with a significant difference between the categories (i.e. ranging from $25-$75 for altered vs. $120-$360 for unaltered).
The City of Menifee, like their counterpart JPA member cities of Murrieta and Temecula, does not include Hobby Breeder licensing options within their respective Licensing Fee Schedules. Each of these cities, however, do include an unaltered licensing fee option that ranges in cost between cities, with Menifee being the highest fee at $80. (the Menifee License Fee Schedule is attached to this report for reference.)
Ultimately, the hobby breeder licensing options fee distinctions between altered vs. unaltered are focused on encouraging spay/neutering by establishing higher licensing costs for unaltered animals. In some cases, set at approximately four times the fee cost of altered animals. This approach is intended to address unregulated smaller scale breeding, which falls outside the purview of state breeding license requirements, and inadvertent breeding resulting from un- spayed/neutered animals.
Deciphering if the Menifee community has prolific backyard breeding activity is a challenge, as the animal population of deliberate small-scale breeding (hobby, responsible/reputable, or backyard breeding) is also comingled with inadvertent breeding. Enforcement of regulations for backyard breeding activity could result in a need for increased enforcement resources to address the larger population, as well as policy review/direction related to deliberate breeding versus unintentional breeding. Focusing efforts on increasing voluntary spay/neutering would help support the reduction of sheltered animals, thereby facilitating the identification of irresponsible backyard breeder activity.
Working collaboratively with AFV, recognizing the existing challenges of regulating small scale breeding, along with a desire to increase the number of dogs and cats that are spayed/neutered and microchipped, a concentrated and continued effort in the following areas will support proactive animal control within our community:

1.Encouraging/motivating voluntary Spay & Neutering:
-Spay/Neuter Vouchers and Mobile Clinic events: With a focus on areas with known concentrated in-take of animals.
2.Supporting microchipping efforts (continue microchipping program with AFV): To streamline pet-owner reunifications and lessen days animals remain in shelter.
3.Education campaigns
- Highlight licensing requirements, benefits of spay/neutering through community events, social media, and city communication platforms.
4.Continued analysis of available data
- Continue to analyze available data to help determine success of on-going education campaigns and spay/neuter and microchipping programs.
Staff believe that the combined efforts of current licensing fee differentiation, spay/neuter/microchipping programs and education, along with routine needs assessments based on available data will support a reduction of animal intakes within our shelter.
