DISCUSSION
Core 5 Industrial Partners, LLC, a Delaware Limited Liability Company (Developer), is currently in various stages of developing three industrial buildings located south of Ethanac Road between Trumble Road and Antelope Road. The three buildings, collectively called “Project”, include:

The Heritage Valley Business Center is a proposed merger of 40.4 gross acres into a single parcel for an industrial building 829,000 square feet in size. The entitlement process for PM 39392 is currently ongoing.

The TUMF Ordinance, which is administered by Western Riverside Council of Governments (WRCOG), requires the developer/owner of a project to pay fees to construct roads that are identified within the TUMF roadway network as regionally beneficial. This cost is assessed to mitigate project-generated traffic impacts on those roads. According to the current schedule of fees, the three industrial buildings associated with this Project are subject to an estimated overall TUMF contribution (TUMF Obligation) of $4,698,174.

The Developer is the owner of the Project and, as such, was conditioned by the City to widen Ethanac Road from two to four lanes between Interstate 215 and Dawson Road and two to three lanes between Dawson Road and Antelope Road. Sections of Ethanac Road borders the cities of Menifee and Perris, with jurisdictional changes occurring through various segments of the roadway between Interstate 215 and Sherman Road. Ethanac Road between Interstate 215 and Trumble Road is within the City of Perris. The centerline of Ethanac Road splits the City of Perris and the City of Menifee jurisdictional boundaries between Trumble Road and Sherman Road. The segment of Ethanac Road between Sherman Road and Antelope Road falls fully within the City of Menifee’s jurisdiction.

Being that this portion of Ethanac Road is a TUMF facility, the Developer is eligible to receive credit toward the Project’s TUMF Obligation, up to an amount established by WRCOG for the facility improvements, for costs incurred to construct the TUMF facilities conditioned via the Project. The attached TUMF Credit Estimate establishes that the Developer is eligible to receive up to $8,433,776 in TUMF credits for eligible work. These credits would first be applied against the Developer’s overall TUMF Obligation for the three buildings in the Project. The Developer also would be eligible for reimbursement of TUMF facility construction costs that exceed their TUMF Obligation. Following application of the full TUMF credits to the overall TUMF Obligation, the Developer’s potential TUMF reimbursement for the Project is estimated to be $3,735,601.

In order to receive TUMF credits for Ethanac Road, the Developer must enter into an Improvement and Credit/Reimbursement Agreement (Agreement) with the City of Menifee, the City of Perris, and WRCOG. The Developer is requesting to enter into the proposed Agreement in order to receive TUMF credits associated with the construction of the Ethanac Road improvements.

STRATEGIC PLAN OBJECTIVE
Connectivity and Mobility

FISCAL IMPACT
There is no fiscal impact to the City associated with the recommended action. All TUMF collection, credit issuance, and reimbursements are processed through WRCOG as the TUMF Program administering agency. Review and approval of credit through WRCOG would be coordinated for future review with all parties to the Agreement, prior to issuance of any credit or reimbursement.
