RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute Contract Change Order No. 4 with Bogh Engineering, LLC, to increase the compensation by $61,217.13, for a total contract amount not-to-exceed $2,850,152.97, for the Paloma Wash Pedestrian Bridge Project, Capital Improvement Program (CIP) Project No. 20-13 located adjacent to Central Park.
DISCUSSION
The Paloma Wash Pedestrian Bridge Project, CIP 20-13 (Project) is near construction completion and will soon be opened as a multi-use elevated path over the Paloma Wash Channel (Channel) adjacent to Central Park. The Project will provide the residential and Civic Center areas west of the Channel, as well as pedestrians and bicyclists, with a direct connection to the commercial areas along Haun Road, east of the Channel. The Project improves connectivity and mobility between Central Park, City Hall, and adjacent residential and commercial centers by allowing visitors and residents to walk or bike across the Paloma Wash Channel to attend events at the future Central Park Amphitheater and City Hall.
On March 5, 2025, the City Council approved a Contract Services Agreement (Agreement) with Bogh Engineering LLC (Contractor), in the amount of $2,710,323.74 to construct the Project.
Construction work for the Project began in June 2025 and included the installation of a pre- purchased prefabricated steel truss bridge, as well as installation of concrete abutments, retaining walls, Americans with Disabilities Act (ADA) compliant ramps, and paved walkways. It also incorporated lighting and unique architectural elements to provide a dynamic and aesthetically pleasing destination, day or night, for all users.
Over the course of the construction period, several small design adjustments were needed to ensure the delivery of a safe and high-quality facility to be enjoyed by the Menifee community for decades to come. Although staff make every effort to carefully study and anticipate the extent of the scope of work required to achieve project goals, work of this nature can impose unforeseen

challenges requiring project scope adjustments. In the case of this Project, design updates to the original bid drawings were required that resulted in the need for construction modifications to the bridge abutments. Additional electrical work, signage, and column related work were also necessary to be added to the Project scope. These changes were each addressed in the form of Contract Change Orders (CCO).
Pursuant to Resolution No. 25-1569 and Menifee Municipal Code §3.12.150, amendments or change orders in the aggregate amount greater than 10% of the agreement amount, or that exceed the City Manager’s signing authority, shall be approved by the City Council. CCO Nos. 1, 2, and 3 were previously administratively approved as their aggregate total remained under the City Manager’s signing authority. The total of these three CCOs is $78,612.10, bringing the overall construction contract with the Contractor to $2,788,935.84, as of the date of this report.
While staff continuously inspected work on the Project throughout the various phases of construction, specific surveys and inspections were performed following the full installation of the bridge with all of its appurtenances. These surveys and inspections were performed specifically to monitor any settling of the facility or changes in the bridge deck slope that may occur as a result of the fully constructed facility weight. Through the surveys conducted, staff noted that minor slope modifications were needed on the bridge deck to ensure full compliance with current ADA requirements. The proposed CCO No. 4 includes $61,217.13 to compensate the Contractor for all costs associated with additional concrete work performed to address the bridge deck modifications. All Project CCOs, including CCO No. 4, are summarized in Table 1 below.
