WHEREAS, the City Council of the City of Menifee, State of California, and KB Home Cal Management Services, LLC, (hereinafter designated as "principal") have entered into an agreement whereby principal agrees to install and complete certain public and/or private improvements, including survey monuments and tie-ins, which said agreement, dated and identified as Subdivision Improvement Agreement for TM31229-2, is hereby referred to and made a part hereof; and WHEREAS, interior survey monuments will not be set at the time of the recordation of the map for the improvements; and
WHEREAS, said principal is required under the terms of said agreement to furnish a bond for the payment of setting of the above-indicated survey monuments; and WHEREAS, pursuant to Section 66496 of the Government Code, principal's engineer or surveyor has certified on the map that survey monuments will be set on or before NOW, THEREFORE, we, the principal and Liberty Mutual Insurance Company as surety, are held and firmly bound unto the City of Menifee hereinafter called (city"), in the penal sum of Twenty Five Thousand and 00/100 dollars ($25,000.00) lawful money of the United States, for the payment of which sum well and truly to be made, we bind ourselves, our heirs, successors, executors and administrators, jointly and severally, firmly by these presents.
The condition of this obligation is such that if the above bounded principal, his or its heirs, executors, administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep and perform the covenants, conditions and provisions in the said agreement and any alteration thereof made as therein provided, on his or their part, to be kept and performed at the time and in the manner therein specified, and in all respects according to their true intent and meaning, and shall indemnify and save harmless city, its officers,

agents and employees, as therein stipulated, then this obligation shall become null and void; otherwise it shall be and remain in full force and effect. there for, tore shal e in seded doss and easonie to the and toes species reasonable attorney's fees, incurred by city in successfully enforcing such obligation, all to be taxed as costs and included in any judgment rendered.
The surety hereby stipulates and agrees that no change, extension of time, alteration or addition to the terms of the agreement or to the work to be performed thereunder or the specifications accompanying the same shall in anywise affect its obligations on this bond, and it does hereby waive notice of any such change, extension of time, alteration or addition to the terms of the agreement or to the work or to the specifications.
The surety further stipulates and agrees that the provisions of section 2845 of the Civil Code are not a condition precedent to surety's obligations hereunder and are hereby waived by surety.

ARTICLE IV - OFFICERS: Section 12. Power of Attorney.
Any officer or other official of the Corporation authorized for that purpose in writing by the Chairman or the President, and subject to such limitation as the Chairman or the President may prescribe, shall appoint such attorneys-in-fact, as may be necessary to act in behalf of the Corporation to make, execute, seal, acknowledge and deliver as surety any and all undertakings, bonds, recognizances and other surety obligations. Certificate of Designation - The President of the Company, acting pursuant to the Bylaws of the Company, authorizes Nathan J.
