FIRST ADDENDUM TO THE AGREEMENT BETWEEN THE
CITY OF MENIFEE AND THE PERRIS UNION HIGH SCHOOL
DISTRICT TO PARTICIPATE IN THE SCHOOL RESOURCE
OFFICER PROGRAM FOR THE 2022-23 THROUGH 2026-27
SCHOOL YEARS
This First Addendum ("Addendum") to the Agreement Between the City of Menifee and the Perris Union High School District to Participate in the School Resource Officer Program for the 2022-23 through 2026-27 School Years ("Agreement"), effective July 1, 2022, is entered into by and between the City of Menifee, a General Law City ("CITY"), and the Perris Union High School District, a public school district ("DISTRICT"). CITY and DISTRICT may be referred to individually as a "Party" and collectively as the "Parties." A. RECITALS
WHEREAS, the Parties entered into the Agreement to provide School Resource Officer ("SRO") services to the DISTRICT; and
WHEREAS, the Parties desire to modify the work schedule of the assigned School Resource Officers to better align with the operational needs of the Menifee Police Department while maintaining continuous law enforcement services to the DISTRICT; and WHEREAS, the Parties acknowledge that the Menifee Police Department assigns two (2) full- time School Resource Officers under this Agreement, one assigned to Heritage High School and one assigned to Paloma Valley High School; and
WHEREAS, the Parties desire to ensure continuity of services by providing for coverage between the assigned School Resource Officers during regularly scheduled days off.
NOW, THEREFORE, the Parties agree as follows:
1. Modification of Section B.2.b – Scope of Work
Section B.2.b of the Agreement is hereby deleted in its entirety and replaced with the following:
b. CITY agrees to assign two (2) full-time School Resource Officers to provide SERVICES under this Agreement at Heritage High School and Paloma Valley High School. Each assigned School Resource Officer shall work a 9/80 work schedule during the academic year. The SROs shall generally work during student instructional days and normal school operating hours in accordance with the DISTRICT's adopted academic calendar, commencing on the first day of student instruction and continuing through the final scheduled instructional day of each academic year.
2. Coverage During Scheduled Days Off
The following subsection shall be added immediately following Section B.2.f, with subsequent subsections renumbered accordingly:
g. Coverage During Scheduled Days Off.
In order to maintain continuity of School Resource Officer services, the Parties agree that when one assigned School Resource Officer is on a regularly scheduled day off associated with the approved 9/80 work schedule, the School Resource Officer assigned to the other Perris Union High School District campus may provide coverage for both school sites as operationally feasible and as needed.
The Parties acknowledge that such coverage is intended to provide continued law enforcement support and visibility within the DISTRICT while recognizing that emergency calls for service, investigations, training, court appearances, staffing levels, and other operational demands may affect the availability of the covering SRO. Nothing in this Addendum shall be construed as requiring continuous physical presence at both campuses simultaneously or limiting the CITY's authority to deploy personnel as necessary to address public safety needs.
3. No Additional Compensation
The following verbiage shall be added to Section 4. COMPENSATION:
Coverage provided by one assigned School Resource Officer for another assigned School Resource Officer during a regularly scheduled day off shall be considered part of the SERVICES provided under this Agreement and shall not constitute ADDITIONAL SERVICES requiring separate approval or compensation by the DISTRICT.
4. Effect of Addendum
Except as expressly modified herein, all terms, conditions, obligations, and provisions of the Agreement shall remain unchanged and in full force and effect.
In the event of any conflict between this Addendum and the original Agreement, the provisions of this Addendum shall govern.
This Addendum shall become effective upon execution by both Parties and shall remain in effect for the remainder of the Agreement unless modified in writing by mutual agreement of the Parties.
