RECOMMENDED ACTION
1. Adopt two budget amendment resolutions (BAR) authorizing the Menifee Police Department to appropriate asset forfeiture funds in the amount of $32,600 for the purchase of a replacement canine and required training and equipment.
DISCUSSION
In August of 2020 the County of Riverside transferred $88,653.07 to the City of Menifee in asset forfeiture funds. These funds were previously overseen by the Riverside County Sheriff’s Department. Through joint task force cases the Menifee Police Department (MPD) has also received an additional $443,341.47 since 2021. These funds are the MPD’s portion of multiple state cases resulting in asset forfeiture funds being allocated through the Department of Justice (DOJ) Equitable Sharing Guidelines. These funds have been deposited into the City’s State Asset Forfeiture Fund (8350-231500) until needed for eligible uses. The MPD has requested previous appropriations of the asset forfeiture funds as shown below in Table 1 below.

The requested appropriations would be allocated to the Capital Outlay and K9 Supplies accounts in the amount of $32,600 to fund the purchase of a patrol K9, equipment and accompanying training. The K9 would be partnered with a patrol officer in the operations unit. The goal of this new K9 is to replace Dino, an existing department K9 who will be retired due to age.
The purchase and corresponding agreement for training of the new K9 would be facilitated through Gold Coast K9. The contract would include the purchase of a pre-trained dog, 30 days of pre-training and a six-week handler course. The remaining balance of funds would be used for needed supplies to outfit the new K9 including kennels, crates, a bite suit, bowls, leads, etc.
Pending the recommended appropriation of $32,600, the remaining balance in the restricted Trust Fund would be $336,860.54.
STRATEGIC PLAN OBJECTIVE
Safe and Vibrant Community
FISCAL IMPACT
Funding for the purchase and training of the canine is available within the Trust Fund which holds a current balance of $369,460.54 received from various asset forfeitures over the last several years. Accordingly, $32,600 from the full amount held in trust will be recognized as revenue in the Trust Fund (8350-434680). The funding would then be transferred out of the Trust Fund (8350- MPD-901100) and transferred into the General Fund (1100-808350). The corresponding expenditures would be appropriated within the General Fund to acquire the canine, equipment and the required training as an asset to the City (1100-MPD-660055 and 652753), as summarized in Table 2 below.

Future fiscal impacts include the cost for care of the K9. Those costs would be budgeted accordingly in future fiscal years.
