RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Public Improvement Agreement and accept securities to guarantee the completion of the required public improvements associated with Fitwell Health Campus (Parcel 3 of PM 18039), by Fitwell Realty, LLC, located west of Interstate 215, south of Garbani Road, and east Haun Road, at the eastern terminus of Serlet Court.
DISCUSSION
Major Plot Plan PLN23-0150, Assessor’s Parcel Number 360-350-014, commonly known as Fitwell Health Campus (Project), proposes the development of an approximately 8.4-acre vacant parcel for mixed use. The project is comprised of two phases, with the first phase consisting of a mixed-use building and the second phase (future) consisting of an office building. The mixed-use building includes a gym, a multi-purpose space, a bodybuilding museum, and a food concession area. The mixed-use building is 69,618 square feet in size, and the office building is 16,616 square feet in size. The Project is located west of Interstate 215, south of Garbani Road, and east of Haun Road, at the eastern terminus of Serlet Court, as shown in the attached location map.
Fitwell Realty, LLC (Developer), a California Limited Liability Company, is now requesting approval of the associated Public Improvement Agreement (Agreement) and bonds associated with the sewer and water improvements within Serlet Court. The Agreement requires that improvement securities are posted to guarantee the completion of the required improvements.
The Agreement requires that public improvements be completed within 12 months from the date of City Council approval.

Staff has reviewed the Developer’s request and determined that the Agreement meets the requirements of the Project’s conditions of approval. A summary of the bond securities being posted to guarantee the required improvements are shown in Table 1 below.

The bond security required for the sewer and water improvements have been provided by the Developer in the total amount of $175,000.00.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. The Developer has paid the necessary plan check fees for the off-site improvements to be completed prior to the issuance of any building permits within the project. Upon completion of the improvements and subsequent acceptance by the City, ongoing maintenance costs would be established for the Project’s annexation area within the City’s maintenance Community Facilities District.
