RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Public Improvement Agreement and accept securities to guarantee the completion of public improvements associated with Plot Plan PLN24-0003, Nerd MD Medical Office, by NerdMD, LLC, located east of Bradley Road and north of Newport Road.
DISCUSSION
Plot Plan PLN24-0003, Assessor’s Parcel Number (APN) 336-180-027, also known as Nerd MD Medical Office (Project), is a proposed development of a 9,103 square foot medical office for commercial purposes. The project also includes 46 parking stalls, landscaping, and a variance for a reduced rear yard setback. The Project is generally located east of Bradley Road and north of Newport Road, as shown in the attached Project Location Map.
NerdMD, LLC (Developer), a California Limited Liability Company, is now requesting approval of the associated Public Improvement Agreement (Agreement) as required by the Project’s conditions of approval. The Agreement requires that improvement securities be posted to guarantee the completion of the required public improvements, and that improvements be completed within 24 months from the date of City Council approval.
Staff has reviewed the Developer’s request and determined that the Agreement meets the Project’s conditions of approval. A summary of the bonds being posted to guarantee the required improvements are shown in Table 1 below.

The securities required for all improvements have been provided by the Developer in the total amount of $65,500.00.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. The Developer has paid all necessary fees associated with the review of the Project. Upon completion of the improvements and subsequent acceptance by the City, ongoing maintenance costs for the improvements would be supported through future fiscal year budgets in maintenance Community Service Area 145.
