RESOLUTION NO. 26 - ______
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MENIFEE AUTHORIZING THE
CITY MANAGER TO ACCEPT CERTAIN
REAL PROPERTY ON BEHALF OF THE CITY
WHEREAS, Legado Community Association, a Nonprofit Corporation (“Grantor”) is the owner in fee of certain real property in the City more specifically described on Exhibit A to Attachment 1 (“Property”); and
WHEREAS, Grantor desires to grant to the City, and the City desires to accept from the Grantor the Property pursuant to a Grant Deed in the form provided on Attachment 1 (“Grant Deed”) ; and
WHEREAS, the City Council now desires to authorize the City Manager to accept the Property on behalf of the City by executing and taking all actions necessary to record a Certificate of Acceptance for the Property in the form provided on Attachment 1 (“Certificate of Acceptance”); and
WHEREAS, City’s acceptance of the Property is not a “project” within the meaning of Section 15378(b)(4) of the California Environmental Quality Act (CEQA) Guidelines (Title 14 of the California Code of Regulations) and is therefore exempt from the requirements of CEQA. WHEREAS, City’s acceptance of the Property is further exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines as it can be seen with certainty that there is no possibility that the acceptance of the Property may have a significant effect on the environment. Any future project or development on the Property would be subject to independent CEQA review at the time such project or development is proposed.
NOW, THEREFORE, the City Council of the City of Menifee does find, determine and declare:
Section 1. The above Recitals are incorporated herein by this reference.
