The West Park is situated within the Project in Lot 117 of Tract 37408-3, a subdivision of 115 single-family residential homes on 45.88 acres and is located south of Rouse Road and west of Rockabilly Drive, as shown in the attached Project Map. As a part of the Project’s conditions of approval, the Developer must enter into the proposed Subdivision Improvement Agreement (Agreement) with the City and provide improvement securities. The Developer constructed the neighborhood park (West Park) with amenities including a picnic area, shade structure, walking paths, and playground structure.

The West Park is now complete, and the Developer is accordingly requesting acceptance of the completed West Park improvements into the City’s maintenance system. The park will be dedicated by the Legado Community Association (HOA) since the ownership was transferred by Lennar during construction. The required 90-day Developer-maintenance period has been completed for the West Park as of the date of this report.

The Public Works Engineering Department and Community Services Department have inspected the completed improvements, determined that the West Park improvements have been constructed in accordance with City specifications and standards, and have verified that all project conditions of approval have been met to release the faithful performance security and material and labor security in accordance with City policy.

A 10% warranty security for the West Park will be held from the faithful performance security for a period of one year in accordance with the City Municipal Code. The posted security improvements are listed in Table 1 below.

The payment bond would be released 90 days after the date of recording of the NOC, unless the City receives written notice of a timely claim against the payment bond pursuant to section 9560 of the Civil Code or a similar provision.
