RECOMMENDED ACTION
1. Approve and authorize the City Manager to execute a Public Improvement Agreement to guarantee completion of the required improvements associated with Assessor Parcel Number (APN) 336-180-030, Denny’s Restaurant, by Menifee Crossroads, LLC, located on the northeast corner of Bradley Road and Newport Road.
DISCUSSION
Parcel 1 of Parcel Merger 24-001, APN 336-180-030, also known as the Denny’s Restaurant (Project), is a proposed restaurant development of approximately 1.70 gross acres for commercial purposes. The Project is located on the northeast corner of Bradley Road and Newport Road.
The Project is conditioned with roadway improvements along its frontage, within the public rightof-way of Newport Road, as shown on the Project location map.
Menifee Crossroads, LLC (Developer), a California Limited Liability Company, is now requesting approval of the associated Public Improvement Agreement (Agreement) as required by the Project’s Conditions of Approval (COA). The Agreement requires that improvement securities be posted to guarantee the completion of the street improvements. The Agreement also requires that public improvements be completed within 12 months from the date of City Council approval.
Staff has reviewed the Developer’s request and determined that the associated Agreement and bonds meet the requirements of the Project’s COAs. A summary of the bonds being posted to guarantee the construction of associated public improvements is provided in Table 1 on the following page.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. The Developer has paid all necessary fees associated with the review of APN 336-180-030. Upon completion of the improvements and subsequent acceptance by the City, ongoing maintenance costs would be supported through future fiscal year budgets in maintenance Community Facilities District 2017- 1 Annexation 43, Zone 43.
