ROLL OFF GARBAGE TRUCK
PART I - BID INSTRUCTIONS
It is the intention of the City of Merced to purchase (2) two new, conventional chassis, Roll-Off Refuse collection truck. It will be operated in business as well as residential areas and will be required to dump in an unimproved landfill site.
Vendors/manufacturers are requested to bid per the specifications.
A. Instructions to Bidders: The complete bid package must be returned intact. Missing pages or missing or incomplete information will be construed by the City to constitute a non responsive bid. Non-responsive bids will be rejected.
A place has been provided for each section for which the bidder must enter either "Yes", No" or "Alternate". Specific sections include the make, model, and other descriptive information needed to clearly describe any alternative offered. If additional spaces are needed, securely attach additional page(s) "Statement of Exception" sheet. Additional pages must be numbered clearly and consecutively, include the section number and · signed by a responsible company official. The City of Merced reserves the right to waive minor variation(s) if in the opinion of the Fleet Manager the basic unit meets the intent of these specifications.
A. Bid Evaluation: Units offered will be subject to analysis and evaluation by the Public Works Department for quality, construction, material, performance characteristics, and compliance with the specifications. The bid evaluation will include, but not necessarily be limited to, the following factors:
1. Purchase price;
2. Delivery time in calendar days;
3. Interchangeability with existing equipment;
4. Warranty; (To include Body, Chassis, Engine, Transmission, Drive Train, Brake System or other pertinent warranties) Dealership shall register all warranties for the buyer.
5. Compliance to specifications.
6. Past Performance.
The City re.serves the right to accept or reject any and all bids based on the results of this inspection.
Nothing in these specifications or invitation to bid shall restrict the right of the City to purchase the vehicle which best meets the needs of the Refuse Division of the Public Works Depart.
B. Bid Response: The bidder shall submit to the City, a complete bid response package detailing the equipment proposed to meet these specifications. lt shall also Include warranty, product support information, and delivery time In calendar days.

Refuse Roll-off
1. Installation, maintenance, and operating manual/instructions, one printed copy and one electronic copy;
2. Itemized parts list;
3. Performance curve;
4. Complete electric and hydraulic schematic for body and chassis;
5. Five (5) sets of ignition and/or door keys;
License and Warranty: The vehicle shall be delivered with the following:
1. The original dealer's report of sale and temporary operating permits (if needed).
2. The vehicle is to be licensed for operation in the State of California by the selling dealer.
3. Copies of all warranties shall be supplied and registered at the time of acceptance.
Bid Response: The bidder shall submit to the City a complete bid response package detailing the equipment proposed to meet these specifications. The bid response shall also include warranty (if different than that specified in Section G, Part 1), product support information, complete manufacturer's published literature, and delivery time in calendar days starting from notice of award.
The unit prices quoted shall remain firm for sixty (60) days. All costs and expenses to meet the requirements of these specifications (including testing) shall be included in the bid response.
Warranty/Product Support: The warranty and product support information requested below is important and will be used in evaluating the bids. Bidders are required to address each of the items below and provide the information with the bid.
1. The vehicle manufacturer shall provide a new vehicle warranty F.O.B. Merced regardless of the method of delivery for the equipment. Note: Warranty time to start when vehicle is fully operational.
2. The complete chassis and components shall be guaranteed under standard factory and/or dealer warranty and a copy of manufacturer's warranty policy shall be delivered with the vehicle. Note: Warranti'. shall be a minimum of one (1) year on all components.
4. Engine shall be guaranteed under the longest and most comprehensive standard factory warranty proposed specifically for municipal equipment.
Specify coverage the attached spec sheet.
5. In the event of warranty repairs. the City of Merced shall be furnished a "no charge" copy of the work order(s) describing type of repairs and parts re laced.

E. Safety:
1. The equipment shall be equipped with all safety markings required. The safety markings shall be color-coded in compliance with the American National Standard Safety Color Code for Marking Physical Hazards, 253.1 (current edition). In addition, any applicable American National Standard Specifications for Accident Prevention Signs, 235.1 shall be installed.
2. The vehicle(s) shall meet all applicable State and Federal OSHA safety requirements.
F. Liquidated Damages: Liquidated damages will be charged at the rate of one tenth of one percent per calendar day of the unit price of the equipment not 1 delivered in accordance with the time specified on the bid oroposal. ! i

A programmable feature that keeps the transmission from shifting from Drive to Rewrse or from Rewrse to Drive abow a preset speed. This wireless function is enabled when a switch is closed to complete the circuit between input wire 101 and ground. Frequently the function is interfaced with a switch indicating activation of another vehicle function, such as application of the service brakes. When the function is enabled, the TCM will recognize the request for a direction change shift, Reverse-to-Drive or Drive-to Reverse. If all other operating conditions are acceptable, the TCM will command the requested shift. The enable remains in effect until the switch is opened, followed by the selection of a different direction, Reverse or Drive, at the shift selector. This could be used for doc spotters and refuse. If the function is not enabled, any shift which results in a change of direction is inhibited.

I Ruckstell California Sales Co. Inc. , hereby authorize work to be done with the necessary material, and hereby grant your employees permission to operate the vehicle herein described on streets, highways or elsewhere for the purpose of testing and/or Inspection. Cost will be no more than the estimated price. However, if Spartan Truck Co., Inc. ("Spartan") discovers that different or additional parts or repairs are needed, a Spartan representative will contact customer for approval of a revised estimate. I have read and understand the estimate and terms below. I authorize the service to be performed including sublet work and acknowledge receipt of this estimate.
Customer is hereby notified that the said property is not insured or protected to the amount of the actual cash value thereof, or otherwise against loss occasioned by theft, fire or vandalism while the property remains with Spartan.
Spartan is not responsible for unavailability of materials or delays in materials shipment beyond Spartan's control.
Parts returned for credit must be accompanied by this document or the appropriate invoice or packing slip and after (10) days are subject to a 15% handling charge. Parts special ordered or custom made are not returnable. No return policy on electrical or sheet metal parts.
Defective goods will be repaired or replaced, but no claims allowed for labor damage. Prices are subject to change without notice.
ALL ACCOUNTS ARE DUE AND PAYABLE 30 DAYS FROM INVOICE DATE. A FINANCE CHARGE OF 1 1/2% PER MONTH (ANNUAL RATE OF 18% WILL BE CHARGED ON ALL PAST DUE ACCOUNTS).
VEHICLES/EQUIPMENT THAT REMAIN UNCLAIMED AFTER 10 DAYS FROM COMPLETION OF WORK WILL BE SUBJECT TO STORAGE FEES OF $35 PER DAY.
California law does not provide for a "cooling off' or other cancellation period for vehicle sales. Therefore, you cannot later cancel this contract simply because you change your mind, decide the vehicle costs too much, or wish you had acquired a different vehicle. After you sign this contract, you may only cancel it with the agreement of Spartan or for legal cause, such as fraud.
Federal law and California law apply to this agreement. If any part of this agreement is not valid, all other parts stay valid. Spartan may delay or refrain from enforcing any of its rights under this agreeement without losing them.
Spartan warrants new parts sold by it to be free from defects in material and workmanship subject to the following provisions. Such parts will be provided without charge to the user at a place of business of a Spartan maintenance department or other establishment authorized by Spartan Truck Co., Inc.
Parts and Labor Warranty are as follows: a) New parts have one (1) year warranty; b) All rebuild and/or repaired parts have ninety (90) days warranty; c) All labor repairs have ninety (90) days warranty. Spartan will provide a new or a rebuilt part, whichever Spartan elects, in place of any parts which are found upon its inspection to be defective in material or workmanship. Parts that fail due to abuse, misuse, neglect, alteration or accident are not covered.
THIS WARRANTY IS EXPRESSLY IN LEIU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE. Remedies under this warranty are expressly limited to the provision of parts as specified above and any claims for loss arising out of the failure of the parts or exchange components to perform for any period of time, or other economic or moral loss, or direct, immediate, special, Indirect or consequential damage are expressly excluded.
In addition to any and all other legal remedies available, I (customer) authorize your repair facility to place a lien on the vehicle described herein for all charges for repairs, including labor and parts, storage and/or towing. To enforce such lien, Spartan is hereby expressly authorized to sell the said vehicle at public auction after giving twenty (20) days written notice by certified mail to the legal owner, registered owner, and Department of Motor Vehicles of intent to do so. On the sale date, the vehicle shall be sold to the highest cash bidder and the proceeds of sale must be used first to satisfy the lien plus storage costs and costs incident to the sale. The balance shall be forwarded to the legal owner, of if none, to the registered owner, or if the address is unknown, it shall be forwarded to the Department of Motor Vehicles.
The said expenses for sale shall also include a reasonable attorney's fee, which may be necessarily incurred. If any of such charged remains unpaid for thirty (30) days after such request for payment, the repair facility may also refer such charge to its attorneys for collection and the customer will pay a reasonable attorney's fee.
Where applicable the Original Equipment Manufacturer or Dealer is responsible for the programming of engine remote throttle operation and over speed protection not to exceed 1500 RPM.
Spartan Truck Co. reserves the right to make engineering changes to its products without obligation to perform these changes to products sold or shipped.
All pricing is in US dollars, and is subject to change without notice.
All Purchase Orders are subject to acceptance by Spartan Truck Company.
