6 7 This Amendment is made and entered into this 22nd day of 8 December _ 2022 _ by and between the SAN JOAQUIN VALLEY UNIFIED 9 AIR POLLUTION CONTROL DISTRICT, a unified air pollution control district formed 10 pursuant to California Health and Safety Code section 40150 et seq. (District), and 11 City of Merced (Participant).
12 WHEREAS, on May 16, 2022 the parties entered into Agreement 13 No. G-122893-A1 for the purchase of one (1) new alternative fuel vehicle. 14 WHEREAS, the parties wish to amend said Agreement.
15 NOW, THEREFORE, in consideration of their mutual promises, the 16 parties agree to amend said Agreement as follows:
17 1. The conditions of the contract in Section 3 shall not change:
18 "the total obligation of the District under this Agreement as follows: compensation "shall 19 not exceed Nineteen Thousand Six Hundred And 00/100 dollars ($19,600.00)". 20 The conditions of the contract shall change as referenced in 21 Exhibit A attached hereto and referenced herein.
22 3. All remaining terms, provisions, covenants, conditions, and 23 promises contained in Agreement No. G-122893-A1 shall remain in full force and 24 effect.
