FIRST AMENDMENT TO AGREEMENT FOR
PROFESSIONAL SERVICES
THIS FIRST AMENDMENT TO AGREEMENT is made and entered into this _day of , 2023, by and between the City of Merced, a California Charter Municipal Corporation ("City"), and RSG, Inc., a California Corporation, ("Consultant").
WHEREAS, City is undertaking a project seeking assistance in evaluating options to expend affordable housing monies in the Low and Moderate Income Housing Asset Fund; and,
WHEREAS, City and Consultant have previously entered into an Agreement for Professional Services ("Agreement") dated August 16, 2021; and, WHEREAS, City and Consultant desire to amend said Agreement to extend the Term of Performance to allow additional time to expend all of the funds; and NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants hereinafter recited, agree as follows:
1. Section 2, "TIME OF PERFORMANCE," is hereby amended to read as follows:
"SECTION 2. TIME OF PERFORMANCE. All of the
work outlined in the original Scope of Services dated
July 1, 2021 attached hereto as Exhibit "A" shall be
extended to end on June 30, 2024."
2. Section 3, "TERM OF AGREEMENT," is hereby amended to read as follows:
"SECTION 3. TERM OF AGREEMENT. The term of
this Agreement shall be extended to end on June 30,
2024."
3. Except as herein amended, the Agreement dated August 16, 2021 shall remain in full force and effect.
