RE: Merced Yosemite Regional Airport Terminal Project (Project No. CP230060) - Bid Protest Mr. Wegley,
Please allow this letter to serve as a formal protest against Thompson Builders Corporation (TBC) for the above-mentioned project.
Per California Public Contract Code Section 1404, each bidding general contractor is to list all subcontractors who will perform work or labor on the project in excess of one-half (1/2) of one percent (1%) of the total bid. Unfortunately TBC failed to fulfill this requirement on their bid submission (Attachment 1). Since TBC's total base bid was $15,459,285, any subcontractor over $77,297 should have been listed on the list of subcontractors, but electrical bids were all around $2M, leaving TBC in violation of the code. TBC does not self-perform electrical work, nor are they properly licensed to do so, and therefore should have listed a subcontractor for the work. If TBC attempts to claim that they will self perform the electrical work please note that they do not hold a C-10 Electrical license nor would they meet any experience/quality assurance requirements in the specifications.
In summation, Thompson Builders is non-responsive, therefore, by the rules set forth in the public contract code their bid should be rejected.
