RESOLUTION NO. 2024-_
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF MERCED, CALIFORNIA,
RECITING THE FACT OF THE PRESIDENTIAL
PRIMARY ELECTION HELD ON MARCH 5, 2024,
DECLARING THE RESULT, AND DECLARING
SUCH OTHER MATTERS AS PROVIDED BY
LAW FOR MEASURE C (MERCED VITAL CITY
SERVICES PROTECTION MEASURE)
WHEREAS, a Presidential Primary Election was held and conducted in the City of Merced, California, on Tuesday, March 5, 2024, as required by law; and WHEREAS, notice of the election was given in the time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in the time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities and consistent with Section 1003 of the Charter; and
WHEREAS, Pursuant to Resolution No. 2023-73 adopted on October 2, 2023, the County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached, and made a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MERCED
DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That the measure (Measure C) voted upon at the election is as follows:
MERCED VITAL CITY SERVICES PROTECTION
"Shall a measure be adopted to convert an existing sales tax of ½ percent to a special tax to be in effect until March 31, 2044, without raising current tax rates,
providing approximately $8,000,000 annually, with

proceeds to be use only for police protection and fire
protection and 5% to be used for road and street
maintenance and improvement?"
SECTION 2. That the whole number of ballots cast in each precinct and the number of votes case in the City for and against the measure are as listed in Exhibit "A" attached.
SECTION 3. The City Council does declare and determine that:
As a result of the election, a two-thirds (2/3) majority of the voters voting on Measure C did vote in favor of it, and that Measure C was carried, and Title 3 of the Merced Municipal Code is amended by adding Chapter 3.38, "Merced Vital City Services Protection Measure General Transactions (Sales) and Use Tax to Merced Vital City Protection Measure Special Transaction (Sales) and Use Tax".
SECTION 4. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election showing:
A. The whole number of the ballots cast in the City;
B. The measure voted upon;
C. The number of votes given at each precinct for and against Measure C; and,
D. The total number of votes given for and against Measure C. ///
